R-91-1607 - 5/23/1991WHEREAS, the City of Round Rock is the owner of a 16.604 acre
tract of land ( "Property ") located adjacent to the residential
development of Oak Bluff Estates, II, which Property has a
recreational swimming pool located thereon, and
WHEREAS, the City has not opened the pool for public use because
projections indicate that the revenues received would be less than the
cost of operating and maintaining the pool, and
WHEREAS, the Oak Bluff Estates II Homeowners Association has
indicated a willingness to guarantee that the City will not lose money
if the pool is opened for public use during the summer of 1991, and
WHEREAS, an Agreement has been prepared to implement said
guarantee arrangement, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City an Agreement with Oak Bluff Estates II Homeowners
Association, said Agreement guaranteeing that the City will not lose
money if the pool is opened for public use during the summer of 1991.
A copy of said Agreement being attached hereto and incorporated herein
for all purposes.

enter into an agreement concerning potential
revenue shortages for the operation of the
Forest Creek Golf Course pool.

STAFF RECOMMENDATION:
The City has not opened the Forest Creek Golf Course pool to
public use because projected costs exceeded projected revenues.
The Oak Bluff Estates Homeowners Association has agreed to
underwrite any loss in order to enable the City to open the pool
this summer. Staff recommends approval of the agreement.
