WHEREAS, the purpose of this grant is to assist communities with
tree planting projects and to provide job opportunities for small
business, and
WHEREAS, the City desires to utilize this grant money to
landscape right -of -ways and mediums at the northern entrances to Palm
Valley Park, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS
That the Mayor is hereby authorized and directed to execute on
behalf of the City an agreement with the Small Business Association
and to provide matching funds of $5,000 for the Small Business
Association Challenge Grant Program.

GRANT AGREEMENT

This Grant Agreement is hereby entered into on this 1st day of
October, 1991, by and between the Texas Forest Service, a part of The Texas
A &M University System, and City of Round Rock, Parks and Recreation Dept.
221 E. Main, Round Rock, Texas 78664, hereafter referred to as "Grantee ".
Purpose: The City of Round Rock purposes to use this grant to assist in
planting trees in recently acquired park. Since the north end of the park
was cultivated farmland, the trees will add both an aesthetic and
environmental value to the park.
Article 1. The Grantee will not let contracts associated with this
agreement to firms with more than 100 employees. Efforts will be made to
divide the project to give more small businesses opportunities to
participate.
Article 2. The Grantee will only utilize the fund from this grant for tree
planting on lands owned or controlled by local or state governments. This
includes payments to small businesses for materials and services relating
to the establishment and maintenance of these trees.
Article 3. The Grantee must provide the Texas Forest Service (TFS) with a
resolution or letter from the respective governing body authorizing its
representative to execute agreements associated with this grant and
committing that agency /organization to its share of the cost of the project
as proposed in the grant application.
Article 4. The Grantee must provide the TFS with a resolution or letter
from the governing body that owns the property where the trees are to be
planted or its agent that grants permission to the Grantee to install this
planting and commits to provide reasonable and appropriate protection for
these trees.
Article 5. All funds must be used for the purposes stated in the
application dated 07- 09 -91. Any modification must be requested in writing
and approved by the TFS.
Article 6. Grantee must raise the entire balance of funds necessary to
complete the budget as proposed.
Article 7. The grant will be paid on a reimbursement basis with payments
eligible to begin following the execution of this contract. The Grantee
will be responsible for a match of not less than $15,000. The Grantee will
be responsible for providing proof of payment of all purchases and in -kind
contributions equal to the total cost of this project.
Article 8. Applicable federal cost principles (OMB A -87 or OMB A -122
attached), federal program regulations (Part 3016 Uniform Administrative
Requirements for Grants and Cooperative Agreements to State and Local
Government attached) and the Grantee's grant application will be followed
in determining reasonableness, allowability and allocation of costs.
Accounting records must be supported by source documentation or cancelled
checks, paid bills, payrolls, time and attendance records, and contract
documents. This includes documentation of third -party in -kind
contribution. This valuation must conform to federal guidelines as defined
in the attached documents.
Article 9. Grantee's procurement procedures must conform to applicable
federal law and standards as defined in attached federal administrative
requirements for grants.
Article 10. The Grantee is responsible for performance reports and
financial reports. Performance reports will be due semi - annually. These
reports will follow the outline and schedule attached.
Article 11. Records must be retained for three years following conclusion
of the project and after other pending matters are closed.
Article 12. The State Forester and the Comptroller General of the United
States, or any of their authorized representatives, shall have the right of
access to any pertinent books, documents, papers, or other records of
subgrantee which are pertinent to the grant in order to make audits,
examinations, excerpts, and transcripts.
Article 13. If a Grantee materially fails to comply with any term of this
award, the TFS may temporarily withhold cash payments pending correction of
the deficiency by Grantee, disallow all or part of the cost of the activity
or action not in compliance, wholly or partly suspend or terminate the
current award for the Grantee, withhold further awards for the program, or
take other legally available remedies.
Article 14. Except as provided in Article 13, awards may be terminated in
whole or part only as follows:
a) By the TFS with the consent of the Grantee in which case the two
parties shall agree upon the termination conditions and, in the case of
partial termination, the portion to be terminated.
b) By the Grantee upon written notification to the TFS, setting forth
the reasons for such termination, the effective date, and in the case of
partial termination, the portion to be terminated.
Article 15. The TFS reserves the right to demand repayment of grant funds
due to insufficient match on the part of Grantee, disallowment of cost
items, or termination of all or part of the project.
Article 16. The Grantee agrees to comply with all the assurances and
certification mandated by federal law and specified in the attachment
"Assurances and Certification."
Article 17. This contract is executed in Brazos County, Texas, this 1st
day of October, 1991.

ECONOMIC IMPACT: $20,000.00
The Parks and Recreation Department applied
for and has been awarded a matching Small
Business Administration grant. This grant,
administration by the Texas Forest Service,
has a two -fold purpose:
1. Assist communities with tree planting
projects.
2. Provide job opportunities for small
businesses.
We applied for a $30,000 (50 -50) grant, but we
were awarded a $10,000 matching grant due to
the demand for funds. Staff proposes that we
not reduce our committed amount ($15,000) so
that adequate irrigation and landscaping can
be provided at both northern entries.
$5,000.00 Provided through the Small Business
Administration and $15,000.00 funded by the
City from interest income from park
improvement G.O. bonds.
