E LAND, Secretary RS10221H RESOLUTION NO. i(07//e- WHEREAS, the Council wishes to ensure that the members of the Round Rock Police Department have training in the use of firearms, and WHEREAS, American Training Systems, Inc. ( "ATS ") has agreed to provide an I.C.A.T. Firearms Training Simulation System to provide the necessary training, and WHEREAS, the Council wishes to approve an agreement with ATS, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City an agreement with ATS for an I.C.A.T. Firearms Training Simulation System for the Round Rock Police Department, a copy of said agreement being attached hereto and incorporated herein for all purposes. WITNESSETH: WHEREAS, ATS and Customer desire to enter into an agreement whereby ATS is to provide certain services enumerated below to Customer in exchange for the amounts set forth below. NOW THEREFORE, in consideration of the mutual promises hereinafter contained and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties hereto do hereby covenant and agree as follows: 1. The Services. Customer will pay ATS the amount of $ C00.00 per day for the following services (the "Services ") to be provided by ATS to Customer at .200$ ou/1)0 " oCK, 76X145 7866(1- . (a) delivery of the I.C.A.T. Firearms Training Simulation System (the I.C.A.T. System) at the beginning of each Service Period (as defined in Paragraph 2 hereof); (b) one 357 revolver, one 9mm semi - automatic pistol and one Remington riot shotgun (the "Guns "); (c) ammunition for the Guns (not "live" and designed for use with the I.C.A.T. System) (the Ammunition, the I.C.A.T. System, and the Guns collectively being referred to herein as the "Equipment "); (d) a technician (the "Technician ") will set up and insure that the I.C.A.T. System and the Guns are operating properly; and (e) the Technician will breakdown and pick up the Equipment at the end of each Service Period. 2. The Service Periods. The Services shall be provided to Customer by ATS during the periods set forth on Exhibit A attached and incorporated herein by reference (each such period being defined herein as a "Service Period "). Full payment for the Services shall be due and payable by Customer upon delivery and set up of the Equipment for each Service Period. 3. Assignment. This Agreement may not be assigned by Customer without the prior written consent of ATS. This Agreement may be assigned by ATS. 4. Controlling Law. This Agreement and the rights and obligations of the parties shall be interpreted in accordance with the laws of the State of Georgia and the State of T IN WITNESS WHEREOF, the parties hereto have executed this Agreement under seal as of the date first above written. DATE: October 18, 1991 SUBJECT: City Council Meeting October 22, 1991 STAFF RESOURCE PERSON: Wes Wolff STAFF RECOMMENDATION: ti ITEM: 10H. Consider a resolution authorizing the Mayor to enter into a contract for computerized video simulator system. This is a firearms training system that will be supplied to the Police Department two times a year for four days each time for a total of 8 training days. This system will enable every officer to receive proper training and is fully computerized. Each officer will be trained under stressful conditions and graded on his /her performance. This is important to the City because it will provide the training necessary in the use of force.
