Problem Statement (See Instructions on pages 13a and 13b.) The City of Round Rock has averaged 10% growth a year over the last several years. • This growth combined with our proximity to Austin has resulted in an increase in crime, particularly controlled substance violations. The Round Rock Police Department currently has one full -time officer assigned to narcotics investigations. Also, one support service officer contributes approximately 75% of his time to narcotics investigations. This program would allow the Round Rock Police Department to focus an additional officer, full time, to the investigation of narcotics. This program will be distinctly . difference from our current emphasis. The officer under this program will target the "small- time" dealers who typically supply those users with limited monies. These traffickers are responsible for a large percentage of "casual use" offenses. We are confident that this program, in conjunction with the Williamson County District Attorney's "Do Drugs Do Time" program, can have a beneficial impact on narcotics activity. In order to have maximum effectiveness this program will place equal emphasis on the demand side of casual use. The officer in this program will document and build cases against the customers of the traffickers under investigation. We believe that pressure applied to both sides of the supply and demand relationship. will have a beneficial impact in our community. 2. Historical Data (See Instructions on pages 13a and 13b.) In fiscal year 91 -92 our narcotics efforts have resulted in 24 arrests and $24,000 asset seizures. We carried over 8 active investigations, with 11 active targets, and 13 future identified targets. Also, 83 persons have been identified as suspects in narcotics activity. We would also cite a three month operation, similar to the objectives of this program, conducted in conjunction with the Williamson County Sheriff's office in the spring of • 1990. The Round Rock Police Department forwarded 75 cases to the District Attorney's office for grand jury indictment. This operation culminated in the largest drug roundup of narcotics offenders in the county's history. Use continuation page(s) as necessary for any section. • CJD -13 3. Proposed Evaluation Design (See Instructions on pages 13a and 13b.) This program will be evaluated based on the number of arrests made, active investigations and people identified for future prosecution. Also the number of control buys and possessions (controlled substances purchased by users who will be prosecuted) will be tabulated. An input (man- hours) to output (activity indicators) ratio will be used to evaluate the officer's performance. The program's effectiveness will also be evaluated by the increase in prosecutions under the aforementioned "Do Drugs Do Time" program. • PART V ASSURANCES The Applicant hereby assures and certifies that he will comply with the regulation, policies, guidelines and requirements including OMB Circulars No. A -122, A -110, A -102, and A-87, as they relate to the application, acceptance and use of Federal funds for this federally- assisted project. Also the Applicant assures and certifies to the grant that: 2. It will comply with Title VI of the Civil Rights Act of 1964 (P. L. 88 -352) and in accordance with Title VI of that Act, no person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimi- nation under any program or activity for which the applicant receives Federal Financial assistance and will immediately • take any measures necessary to effectuate this agreement. 3. It will comply with Title VI of the Civil Rights Act of 1964 (42 USC 2000d) prohibiting employment discrimination where (1) the primary purpose of a grant is to provide employment or (2) discriminatory employment practices will result in unequal treatment of personswho areorshould be benefiting from the grant -aided activity. 1. It possesses legal authority to apply for the grant; that a resolution, motion or similar action has been duly adopted or passed as an official act of the applicant's goveming body, authorizing the filing of the application including all under- standings and assurances contained therein, and directing and authorizing the person identified as the official represen- tative of the applicant to act in connection with the application and to provide such additional information as may be re- quired. 4. It wit comply with requirements of the provisions of the Uniform Relocation Assistance and Real Property Acquisi- tions Act of 1970 (P. L. 91 -646) which provides for fair and equitable treatment of persons displaced as a result of Federal and federally assisted programs. 5. It will comply with the provisions of the Hatch Act which limit the political activity of employees. 6. It will comply with the minimum wage and maximum hours provisions of the Federal Fair Labor Standards Act, as they apply to hospital and educational institution employees of State and local governments. 7. It will establish safeguards to prohibit employees from using • their positions for a purpose that is or gives the appearance of being motivated by a desire for private gain for themselves or others, particularly those with whom they have family, business, or other ties. 8. It will give the sponsoring agency or the Comptroller General through any authorized representative the access to and the right to examine all records, books, papers, or documents related to the grant. I..JU -14 9. It will comply with all requirements imposed by the Federal sponsoring agency concerning special requirements of law, program requirements, and other administrative require- ments. 10. It will insure that the facilities under its ownership, lease or supervision which shall be utilized in the accomplishment of the project are not listed on the Environmental Protections Agency's (EPA) list of Violating Facilities and that it will notify the Federal grantor agency of the receipt of any communi- cation form the Director of the EPA Office of Federal Activi- ties indicating that a facility to be used in the project is under consideration for listing by the EPA. 11. 'twill comply with the flood insurance purchase requirements of § 102 (a) of the Flood Disaster Protection Act of 1973, Public Law 93 -234, 87 Stat. 975, approved December 31, 1976. Section 102 (a', requires, on and after March 2, 1975, the purchase of flood insurance in communities where such insurance is available as a condition for the receipt of any Federal financial assistance for construction or acquisition purposes for use in any area that has been identified by the Secretary of the Department of Housing and Urban Develop- ment as an area having special flood hazards. The phrase "Federal financial assistance" includes any form of loan. grant, guaranty, insurance payment, rebate, subsidy, disaster assistance loan or grant, or any other form of direct or indirect Federal assistance. 12. It will assist the Federal grantor agency in its compliance with § 106 of the National Historic Preservation Act of 1966 as amended (16 U. S.C. 470), Executive Order 11593, and the Archeological and Historic Preservation Act of 1966 (16 U. S. C. 469a-1 et seq.) by (a) consulting with the ...Tate Historic Preservation Officer on the conduct of investigations, as necessary, to identify properties listed in or eligible for inclusion in the National Register of Historic Places that are subject to adverse effects (see 36 CFR Part 800.8) by the activity, and notifying the Federal grantor agency of the existence of any such properties, and by (b) complying with all requirements established by the Federal grantor agency to avoid or mitigate adverse effects upon such properties. 13. It will comply with the Uniform Grant and Contract Manage- ments Standards (UGCMS) developed under the t.irective of the Uniform Grant and Contract Management Act of 1981, Texas Civil Statutes, Article 4413 (32g). 14. It, if a county. has taken or will take all action necessary to provide the Texas Department of Criminal Justice and the Department of Public Safety any criminal history records maintained by the county in the manner specified for the purposes of those departments. • (6) The applicant assures that it will comply, and all its contractors will comply, with the nondiscritnination requirements of the Justice Assistance Act; Title VI of the Civil Rights Act of 1964; Section 504 of the Rehabilitation Act of 1973, as amended; Title IX of the Education Amendments of 1972; the Age Discrimination Act of 1975; the Department of Justice • Nondiscrimination Regulations 28 CFR Part 42, Subparts C, D, E, and G; and Executive Order 11246, as amended by Executive Order 11375, and their implementing regulations, 41 CFR Part 60.1 ,sew., as applicable to construction contracts. (7) CERTIFIED ASSURANCES The applicant assures that federal funds made available under this formula grant will not be used to supplant state or local funds but will be used to increase the amounts of such funds that would, in the absence of federal funds, be made available for law enforcement activities. The applicant assures that matching funds required to pay the non - federal portion of the cost of each program and project, for which grant funds are made available, shall be in addition to funds that would otherwise be made available for law enforcement by the recipients of grant funds. The applicant assures that fund accounting, auditing, monitoring, and such evaluation procedures as may be necessary, to keep such records as CJD shall prescribe, shall be provided to assure fiscal control, proper management, and efficient disbursement of funds received under the grant. The applicant assures that it shall maintain such data and information and submit such reports, in such form, at such times, and containing such information as CJD may require. The applicant certifies that the programs contained in its application meet all requirements, that all the information is correct, that there has been appropriate coordination with affected agencies, and that the applicant will comply with all provisions of the grant and all other applicable federal and state laws, regulations, and guidelines. The applicant assures that in the event a federal or state court or federal or state administrative agency makes a finding of discrimination after a due process hearing on the grounds of race, color, religion, national origin, or sex against a recipient of funds, the recipient will forward a copy of the finding to the Office of Civil Rights Compliance (OCRC), Office of Justice Programs, and the Criminal Justice Division.
