Chamber of Commerce as evidenced by its Resolution which is
attached to this Petition as Exhibit B.
2. Statement of Intent:
Petitioners desire to appear on behalf of the City of Round
Rock, Williamson County and MB Boardwalk Limited, an

organization comprised of two or more persons whose principal
office is located in Williamson County, Texas.
3. Delegation Request:
The subject of the proposed presentation is a request that the
Texas Department of Transportation allocate funds for: a) any
necessary environmental impact studies; b) the purchase of
right -of -way; c) the design; and d) construction of the
interchange improvements on Interstate 35 at its intersection
with FM 1325 and Williamson County Road 170 in Williamson
County, Texas.
4. Basic Data:
a. The highways involved are IH -35, FM 1325 and Williamson
County Road 170 (FM 1325 and CR 170 are part of the
proposed SH 45).
b. The limits of this proposed project are summarized as
follows:
(1) IH -35 Frontage Roads from 750 feet south of CR 170
to 1000 feet north of FM 1325;
(2) SH 45 North Frontage Road from 1200 feet west of
IH -35 to 900 feet east of Greenlawn Boulevard;
(3) FM 1325 and CR 170 from 1200 feet west of IH -35 to
900 feet east of Greenlawn Boulevard.
c. The existing facility consists of the following
components: ,
(1) IH -35 frontage roads (two -lane, one -way) which
intersect FM 1325/CR 170; -
(2) FM 1325 which is a five lane roadway (3 eastbound
lanes) connecting from the west at this
intersection;
(3) CR 170 which is a five lane roadway (2 westbound
lanes and a striped out center lane) connecting
from the east at this intersection; and,
(4) FM 1325/CR 170 bridge (5 lanes plus an additional
15 feet available roadway which is currently
striped out on both the north and south sides of
the bridge).

d. The requested improvement consists of acquisition of
right -of -way and construction of the following components
of the IH -35 interchange at SH 45:
(1) IH -35 East Frontage Road - Widening of the existing
pavement from 750 feet south to 1000 feet north of
CR 170 to provide three northbound lanes with a
right turn lane at CR 170 (SH 45 South Frontage
Road);
(2) IH -35 West Frontage Road - Widening of the existing
pavement from 1000 feet north to 750 feet south of
FM 1325 to provide three southbound lanes with a
right turn lane at the SH 45 North Frontage Road;
(3) SH 45 North Frontage Road from 1200 feet west of
IH -35 to 900 feet east of Greenlawn Boulevard,
including a three lane bridge over IH -35 with
turnarounds east and west of the existing frontage
roads;
(4) FM 1325 - Resurfacing and pavement markings from a
point 1200 feet west to IH -35; and,
(5) CR 170 - Resurfacing and pavement markings from IH-
35 to 900 feet east of Greenlawn Boulevard,
including five lane pavement section of Greenlawn
Boulevard between SH 45 Frontage Roads.
e. The applicable Metropolitan Planning Organization is the
Policy Advisory Committee of the Austin Transportation
Study (ATS).
f. The population figures of the city and county involved
are set out below. The 1990 Census did not report Round
Rock's population as a separate number. Petitioners
have, therefore, based Round Rock's population on Round
Rock Chamber of Commerce estimates. Williamson County's
population is shown as estimated by the 1990 Census.
Round Rock population: 36,000
Williamson County population: 139,551
5. Background:
The requested improvements are needed immediately to handle
increased demand which arises from the relocation to the IH -35
and CR 170 intersection of Dell Corporation (one of Central
Texas' major employers) and from the high volume retail uses
currently proposed at the northwest quadrant of this
intersection. This explosion of demand at the intersection

exacerbates problems already arising from demands of
increasing growth in the area generally. The existing
facility cannot accommodate the increased trips generated by
this growth. Present and currently projected growth create a
critical need for the improvements requested in this petition.
This intersection is of major importance to the highway system
in the area. The future and ultimate design of this
intersection contemplates a multilevel interchange with full
four -way direct connector lanes. This petition requests
funding for interim improvements and right -of -way acquisition
that are consistent with and will become part of the ultimate
facility.
The highways that intersect with IH -35 at this location
provide significant connections to the Travis and Williamson
County transportation system. FM 1325 connects IH -35 and the
present northern terminus of MoPac. CR 170 connects IH -35 and
the proposed MoKan facility.
6. Petitioners have employed an engineer to assist in preparing
the data required in this petition. That engineer reviewed a
preliminary environmental impact statement prepared for
District 14, Texas Department of Transportation in conjunction
with the preliminary engineering and design for SH 45 at the
location of the improvements requested in this petition.
Petitioners are advised and represent to the commission that
there are no known potential adverse impacts on the
environment in the particular area relevant to this request.
Comments concerning the environmental impact are more fully
set out in the Traffic Impact and Highway Facility Needs Study
which is attached to this petition as Exhibit A. (See p. 15.)
7. Estimated Costs:
Right -of -Way $3,997,936
Construction $1.926,000
TOTAL $5,923,936
At this time MB Boardwalk Limited controls land that is
required for construction of the proposed interim facility and
is also required for the ultimate facility. If timely
acquired, MB Boardwalk Limited would transfer the right -of -way
to the State for the market value of the land only and would
waive any claim for additional compensation for any damages to
the remainder of MB Boardwalk's property. This represents a

significant savings in right -of -way costs because a retail
shopping center with pad sites will be constructed on this
site in the near future. A year from now, when MB Boardwalk
loses control of the land and it is developed as proposed, MB
Boardwalk Limited will no longer be able to effect the waiver
of remainder damages. Eventually when this intersection is
improved, these damages could well be significant especially
as measured consistent with what will then be the existing
shopping center and pad uses.
8. Local Participation:
In addition to the right -of -way that was in CR 170 prior to
the Commission minute order creating SH 45, the total right -
of -way required for these improvements is estimated to be
25.24 acres. Williamson County has acquired approximately 9.2
acres, or roughly 40% of the right -of -way.
Williamson County will dedicate that right -of -way to the
State.
MB Boardwalk Limited, or its principals, donated this
approximately 9.2 acres to Williamson County. Additionally,
MB Boardwalk Limited or its principals spent $921,204.00 on
construction of County Road 170. This construction will be
utilized as part of this highway improvement.
If necessary, Petitioners ask that waivers be granted
exempting the City of Round Rock from any requirement for
additional local government participation and Williamson
County from any requirement to obtain right -of -way for the
north side of CR 170 from IH -35 to 900 feet east of Greenlawn
Boulevard.
9. Metropolitan Planning Organization Position:
The improvements sought in this petition are contained in
ATS's long range plan as more specifically evidenced in the
Traffic Impact and Highway Facility Needs Study which is
attached as Exhibit A to this petition. (See p. 5.)

great importance both to the businesses who have chosen or will in
the future choose to locate at or near that intersection and to the

WHEREAS, Dell Corporation has announced its relocation to the
northeast quadrant of that intersection; and
WHEREAS, the construction of a retail shopping center with several
retail pad sites adjacent to IH -35 and CR 170 has also been
announced; and
RESOLUTION
WHEREAS, because of present growth in South Williamson County, the
existing highway facilities at the intersection of IH -35 and CR
170 /FM 1325 are currently operating beyond their desirable level of
service and are rapidly approaching an unacceptable level of
service; and
WHEREAS, the capacity of the existing highway facilities at that
intersection cannot accommodate the increased vehicle trips
generated by the current and projected growth in this area; and
WHEREAS, the Austin Transportation Study (ATS) and Texas Department
of Transportation District 14 (TxDoT) show in their long- range
plans that they intend construction of a multilevel interchange
with four -way direct connectors at this intersection; and
WHEREAS, certain interim improvements are required in the immediate
future to relieve the traffic problems that are the result of
present and projected growth from currently planned projects; and
WHEREAS, the principals of MB Boardwalk Limited have, at their
expense, employed consultants and attorneys to assist in the
preparation of a Petition for Delegation Appearance before the
Texas Transportation Commission at its meeting on September 28,
1993, to request funding to design and construct these interim
improvements; and
WHEREAS, in conjunction with Minute Order No. 83158, dated May 22,
1985, Williamson County has acquired approximately 9.2 acres of the
right of way that will be needed to construct these interim
improvements; and
WHEREAS, the proposed interim improvements and the ultimate
facility contemplated in the ATS and TxDoT long -range plans are and
will be required at this intersection regardless of the future
construction of SH 45 proposed in Minute Order No. 83158;
NOW THEREFORE, BE IT RESOLVED THAT,
The County Judge of Williamson County, Texas, is hereby authorized
to sign the Petition for Delegation Appearance prepared by MB
Boardwalk Limited seeking that the Texas Transportation Commission
recognize the critical need for the interim improvements proposed
in that petition and fund the construction of those improvements
and the acquisition of right -of -way necessary for such
construction.
FURTHER, the County Judge is hereby authorized to appear, or to
request a county commissioner to appear, with the delegation before
the Transportation Commission on behalf of Williamson County to
support the petition and to seek a waiver, if necessary, from any
further requirement that Williamson County obtain right -of -way on
the north side of CR 170 from IH 35 to 900 feet east of Greenlawn
Boulevard.
FURTHER, upon acceptance by the Texas Transportation Commission of
the requests and waivers sought by the aforementioned petition, and
conditioned expressly upon that acceptance, the County Judge is
hereby authorized to transfer ownership of the aforementioned
approximately 9.2 acres of land to the State of Texas for use as
highway right -of -way.
The foregoing resolution having been duly posted and presented to
the Commissioners' Court of Williamson County was, upon proper
motion and second, passed and adopted by the Commissioners' Court
for Williamson County on July 12, 1993.

The attached resolution authorizes the Mayor to sign a petition for a delegation
appearance before the Texas Transportation Commission on September 28, 1993.
The purpose of the appearance will be to present our case for the need of
improvements to the IH -35, FM 1325, CR 170 intersection. The proposal seeks
funding from the state for the purchase of the necessary right of way and
construction of the following components:
1. 1H 35 East Frontage Road - Widening of the existing pavement from 750 feet
south to 1000 feet north of CR 170 to provide three northbound lanes with a
right turn lane at CR 170 (SH 45 Frontage Road);
2. IH -35 West Frontage Road - Widening of the existing pavement from 1000
feet north to 750 feet south of FM 1324 to provide three southbound lanes
with a right turn lane at the SH 45 North Frontage Road;
3. SH 45 North Frontage Road from 1200 feet west of IH -35 to 900 feet east of
Greenlawn Boulevard, including a three lane bridge over IH -35 with
turnarounds east and west of the existing frontage roads;
4. FM 1325 - Resurfacing and pavement markings from a point 1200 feet west to
IH -35; and,
5. CR 170 - Resurfacing and pavement markings from IH -35 to 900 feet east of
Greenlawn Boulevard, including five lane pavement section of Greenlawn
Boulevard between SH 45 Frontage Roads.
Economic Impact:
