WHEREAS, the Health District has requested the City's approval
of two amendments to the Agreement, and
WHEREAS, the City Council wishes to approve of said amendments,

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,

That the Mayor is hereby authorized and directed to execute on
behalf of the City an amendment to the Agreement, such amendment to be
in accordance with Exhibit

5. The' DIRECTOR shall be the Chief Executive Officer of the HEALTH D1S`FRICT and
shall actively manage the day -to -day operations of the DISTRICT stall. The DIRECTOR
shall also serve as the County Health Authority (formerly called the County Health
Officer) and as the City Health Authority (formerly the City Health Officer) for all
member cities, as needed. A Health Authority has certain duties prescribed by State Law
which are necessary to implement and enforce to protect the public health. He /she shall
aid the BOARD in all matters of local quarantine, disease prevention and suppression,
sanitation inspection and control of contagious, infectious, and dangerous epidemic
diseases within the Health Authority's jurisdiction.
6. The DIRECTOR's position is funded by the Texas Department of Health. If, during the
annual evaluation of the DIRECTOR, two - thirds of the BOARD judge the DIRECTOR
to be guilty of neglect of duty, malfeasance, or unbecotning behavior, a petition for
his /her removal shall be addressed to the Texas Commissioner of Health (hereinafter
Commissioner). !n the event of death, resignation, or removal from office, the BOARD
shall advertise the vacancy, submit the list of applicants to the Commissioner for a
review of his or her qualifications, and then the BOARD shall select the new
DIRECTOR from a list of applicants approved by the Commissioner.

Enclosed you will find the Independent Auditors' report of the Health
District's operating budget for 1992. The Board of Health reviewed
and accepted this report at their meeting April 29, 1993. This copy
is for your review. If you have any questions, I will be happy to
discuss this report with you.
Also enclosed is an amendment to the Health District's Cooperative
Agreement which will require approval and signature by the member
governments. This amendment has been approved by the Board of Health.
This amendment is necessary because, with the departure of Dr.
Clarence Skrovan, the position of Health District Director is no
longer a state employee position. The Texas Department of Health, by
its decision, has shifted salary funds to a grant to convert this
position to a local Health District position. Therefore, the hiring
and firing of the Director is also shifted to local control. The
other revision addresses the position of County Health Authority if
the Director is a physician or a non - physician.

SUBJECT: City Council Meeting, August 12, 1993
ITEM: 9B. Consider a resolution amending the Williamson County
and Cities Health District Cooperative Agreement.
STAFF RESOURCE PERSON: Joanne Land
STAFF RECOMMENDATION: The Williamson County & Cities Health District Board
is requesting two changes to the current agreement between that body and the
cities in Williamson County. With the resignation of Dr. Clarence Skrovan, the
director's position is no longer a state funded position but rather a Health
District funded position. Thus, the hiring and firing of the director has shifted
to local control. Under the current agreement, the director is employed by the
State Health Department. The Board is asking that current language be amended
to reflect the enacted change.
The second amendment request addresses the professional status of the
director's position. In the current agreement, the director has to be a board
certified physician. The Board is requesting that it be optional as to whether
the director is a physician or a non - physician. The current director Karen
Wilson is not a physician.
The staff recommends that both of these requests be approved.
