WHEREAS, Mrs. Delia Lane, a citizen of Round Rock who
resides at 402 Round Rock Avenue, recently discovered that portions
of her property encroach upon the City right -of -way on West Austin
Avenue; and
WHEREAS, Mrs. Lane desires to resolve this problem by
acquiring three small tracts totaling 3,427 sq. ft. and lying
within the City right -of -way on West Austin Avenue, said tracts
being described in Exhibit "A ", attached hereto and incorporated
herein; and
WHEREAS, Section 272.001 of the Local Government Code,
V.A.T.S., allows a city to convey small strips of land without
following the normal notice and bidding procedures; and
WHEREAS, Appraiser Larry Kokel has estimated the fair market
value of the property described in Exhibit "A" to be $3,430.00; Now
Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City a real estate contract for the conveyance by
special warranty deed the real property described in Exhibit
herein.

BEING a part of the WILEY HARRIS SURVEY, ABSTRACT NO. 298, in the
City of Round Rock, Williamson County, Texas, and being more
particularly described by metes and bounds as follows, to wit:
BEGINNING at an iron rod found at the northeast corner of Lot 6,
Block 32, of the Original Town of Round Rock, according to the
map or plat thereof recorded in Cabinet A, Slide 190, Plat
Records of Williamson County;'
THENCE S 72° 53' 27" W a distance of 198.56 feet with the north

Austin Avenue, to an iron rod set at the most westerly corner of

Re: Appraisal of a parcel of land totaling 3,427 SF located
on the south side of West Austin Avenue, east of Round
Rock Avenue, Round Rock, Williamson County, Texas.

On January 9, 1994, Kokel Appraisal Associates made an appraisal on
three parcels of land totalling 626 SF and located on the south
side of West Austin Avenue, east of Round Rock Avenue. These three
parcels are owned by the City of Round Rock, being right -of -way,
but were improved with portions of a house and detached garage
owned by Delia Mae Lane. The purpose of the appraisal was to
estimate the market value of the underlying land. The function of
the report was to assist the City of Round Rock in selling the
underlying land to Ms. Lane as to eliminate the encroachment of the
house and garage on City of Round Rock right -of -way. The concluded
value of the underlying land was $630.
As requested by Hugh T. Bender, AICP and Principal Planner with the
City of Round Rock, we are modifying that report to reflect the
appraisal of one parcel totaling 3,427 SF that is inclusive of the
three parcels appraised as well as yard area out to a perimeter
chain link fence. A plat of this parcel is attached as Exhibit A.
This letter is being written to convey our conclusion of market
value based on the appraisal of the 3,427 SF parcel. This letter
serves as an attachment to the January 9, 1994 report and is not an
appraisal in and of itself.
Although the configuration and size of the parcel has changed, the
highest and best use analysis presented in the previous report
remains applicable. In the appraisal analysis, the Cost and Income
Approaches to value were and remain not applicable as the appraisal
is of the underlying land.

The comparable sales and sale analysis presented in the January 9,
1994 report is also applicable in the appraisal of the 3,427 SF
parcel. This parcel ranges in depth from 16 to approximately 20
feet, with the width being an average of 190 feet. The modified
parcel has size and dimensions which restricts usability which is
discussed in the adjustment discussion of the Sales Comparison
Approach. Based on the analysis presented in the previous report,
the estimated market value of the 3,427 SF parcel as of January 9,
1994 was $1.00 /SF or:
