agreement being attached hereto and incorporated herein for all
purposes.

Thank you for the opportunity to present this proposal to the City of Round Rock, Texas. This
scope of work describes the activities necessary to evaluate potential environmental effects of a
new, planned raw water pipeline, and to obtain the permits necessary for the project to go
forward.
We understand that the raw water pipeline proposed by the City of Round Rock will originate at
the existing Lake Georgetown water intake located on U.S. Army Corps of Engineers (USCE)
property. Most of the line will follow existing rights of way (ROW), although some widening of
existing easements will be required. Stream crossings will include Middle Creek and the South
Fork of the San Gabriel River, and the proposed ROW may traverse areas of juniper -oak
woodland and of karst geology. The proposed project is subject to the provisions of Section 404
of the Clean Water Act (33 USC 1344), under which the USCE regulates the placement of
dredged or fill material into the waters of the United States and adjacent wetlands, the
Endangered Species Act (16 USC 1531 et seq), and portions of the Texas Water Code involving
water rights pennits. Cultural resource protection on public lands (including utility line
easements), or lands affected by projects regulated under federal permits, is afforded by the
National Historic Preservation Act (PL 96 -515), the Archaeological and Historic Preservation Act
(PL 93 -291), and the Antiquities Code of Texas (TAC 191.051 - 191.174).
Water for this line will be diverted under an existing water rights permit. The USCE will take
jurisdiction over those parts of the project directly affecting wetlands (stream crossings) and
USCE property. Since the only wetlands to be affected by this project are the streambeds that
will be crossed, the pipeline is eligible to proceed under Nationwide Permit No. 12, Utility Line
Backfill and Bedding. Nationwide permits (NWPs) are a type of general permit designed to
regulate activities having minimal impacts with little paperwork and delay. However, the project
must comply with all of the conditions, limitations and restrictions of the NWP, and these include
provisions protecting federally listed endangered and threatened species, cultural resources, and
requirements for minimization of wetland disturbance and immediate bank stabilization and
revegetation. The U.S. Army Corps of Engineers (USCE) manager at Lake Georgetown has
jurisdiction over activities on USCE property there, and will be expected to consider endangered
species and cultural resources in reaching an easement agreement with the city.
The applicant is expected to consult with the U.S. Fish and Wildlife Service (FWS) to evaluate
the potential for adverse impacts to federally protected species in upland areas not under federal

control. Likewise, the applicant must consult with the State Historic Preservation Officer
(SHPO) concerning the presence of sites with historical or archaeological significance. If it is
found that project construction or maintenance is likely to result in an adverse impact, the
resource agencies strongly prefer that the offending project features be relocated or changed to
the extent necessary to avoid the impact. Where impacts cannot be completely avoided, they
must be minimized to the extent possible, and even then compensation for unavoidable impacts
are generally required.
To assure fair consideration and the most rapid response possible, Paul Price Associates, Inc.
recommends that the City of Round Rock develop the necessary information to evaluate potential
environmental and cultural resources effects, seek comment from the appropriate resource
agencies (in this case the FWS and SHPO), and resolve any concerns those agencies may have
about project impacts. This information would be submitted to the USCE manager at Lake
Georgetown, and to the District Engineer along with notification of the city's intent to proceed
under NWP 12. The District Engineer would then have 30 days in which to notify the applicant if
he believes the activity does not comply with the conditions of the NWP, otherwise the city would
be free to proceed once the USCE easement was obtained. Issues associated with the portion of
the pipeline on USCE property, including endangered species and cultural resources, will be
handled within the framework of your agreement with the manager of the USCE property at Lake
Georgetown.
Paul Price Associates, Inc. will undertake the activities necessary to assure compliance of the
Lake Georgetown raw water pipeline with applicable state and federal environmental and cultural
resources regulations. These include: 1) data review necessary to obtain up to date information
on known habitats and occurrences of federally listed species in the project area, 2) file search to
determine the presence of known cultural resources potentially affected by the proposed pipeline,
3) field surveys (endangered species habitat evaluation, significant cultural resources, and wetland
habitats at stream crossings), 4) coordination with appropriate agency staff (by telephone, FAX,
meetings, preparation of technical memoranda, letters, and reports, as necessary) to establish
issues of concern and resolve conflicts, and 5) assistance in preparing the notification to the
USCE of the city's intent to proceed under NWP 12, and in resolving environmental and cultural
resources issues on USCE property at Lake Georgetown.
The endangered species task is expected to focus on the Golden Cheeked Warbler (Dendroica
chrysoparia), Black- Capped Vireo (Vireo atricapillus), and on cave invertebrates that may be
present in karstified limestones. The cultural resources task includes obtaining an antiquities
permit to conduct the survey, a 100 percent pedestrian survey of previously unsurveyed areas,
preparation of a survey report to the Antiquities Committee of the Texas Historical Commission,
and coordination with the State Historic Preservation Office. USCE notification will contain the
results of all surveys, and of our consultations with the resource agencies. Additional field studies
that might be required to resolve resource issues (for example, a spring nesting survey for Golden
Cheeked Warblers, or excavations for buried cultural deposits) cannot be predicted at this time,
are not included in this scope of work, and would not be undertaken without the prior, written
agreement of the City of Round Rock, Texas.

Paul Price Associates, Inc. maintains adequate general and automobile liability, and workmen's
compensation insurance, and a certificate of insurance can be provided on request. Based on the
enclosed rate schedule, our estimated cost for the services outlined above would in no case
exceed $8,000, including non labor expenses. No service or handling fee will be added to non
labor charges. Labor effort will be distributed approximately as follows:

RATE SCHEDULE
Labor is billed at fixed hourly rates that include salary cost, benefits and overhead. Rates for
the various labor grades as of 1 June 1992 are:

Clerical /Drafting $22.00/h
Items including subcontract services, rental equipment and expendable supplies, computer
time, telephone and reproduction are billed at actual cost plus a 10 percent service charge.
Travel
Mileage is billed at $0.28 /mile for ordinary travel. Subsistence expenses, air fares and use of
rental vehicles are treated as purchased services and billed at actual cost plus 10 percent.
Invoices are submitted monthly for actual work performed during the preceding month and are
payable within 30 days. Late charges are not ordinarily assessed, but work may be stopped if
payment is not received within the stated period.

In order to gain approval to construct the Raw Water Line from Lake
Georgetown, an Environmental survey is required. Paul Price and Associates has
successfully performed this work for the City in the past and staff recommends
entering into this agreement. The cost to do this work is established at $ 8,000.
