R-94-11-10-10E - 11/10/1994WHEREAS, City of Round Rock desires to utilize the prevailing wage rate survey conducted by the Austin Independent School District to satisfy the requirements of Article 5159a, Texas Revised Civil Statutes Annotated; Now Therefore, RESOLUTION NO. /e ` 9 // /0- /OLT_ WHEREAS, the City of Round Rock, Texas engages in public works projects from time to time; and WHEREAS, Article 5159a of Texas Revised Civil Statutes Annotated requires the public body awarding a contract for public works to ascertain and specify in the call for bids for said contract the general prevailing rate of per diem wages in the locality in which the work is to be performed for each craft or type or workman or mechanic needed to execute the contract; and WHEREAS, to ascertain the general prevailing wage rate, the public body must either conduct a survey or adopt the prevailing wage rate as determined by the U.S. Department of Labor in accordance with the Davis -Bacon Act, if the survey on which the Davis -Bacon rate was founded was conducted within three years prior to the bidding of the project; and WHEREAS, the survey on which the Davis -Bacon rate for Williamson County and the surrounding area was founded was conducted more than three years ago; and WHEREAS, the Austin Independent School District has conducted a survey to determine the prevailing wage rate for the Austin area; and ES /RESOLUTION RS41110E BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the City of Round Rock hereby adopts the Prevailing Wage Rates as determined by the survey provided by the Austin Independent School District, a copy of which is attached hereto as an exhibit. DATE: November 8, 1994 SUBJECT: City Council Meeting, November 10, 1994 ITEM: 10E. Consider a resolution adopting Prevailing Wage Rates. STAFF RESOURCE PERSON: Steve Sheets STAFF RECOMMENDATION: The purpose of this resolution is to comply with Article 5159(a) of the Texas Civil Statutes as amended by the 73rd Legislature. This amendment relates to the payment of certain laborers, workers, and mechanics under public contracts. The amendment provides a procedure which cities with a population of more than 10,000 residents must follow when a dispute arises as to whether the proper prevailing wage has been paid. Failure of the City to ascertain and specify in the call for the contract the prevailing wage rate in that locality relieves the contractor or subcontractor from liability under the act.
