WHEREAS, the cities of Georgetown, and Round Rock desire to
enter into an Interlocal Agreement ( "Agreement ") for the use of VHF
mobile and portable radios hereinafter called "radios "; and
WHEREAS, the Interlocal Cooperation Act, Chapter 771 of the
Texas Government Code provides for any local government to contract
with one or more local governments to perform governmental functions
and services under the term of the Act; and
WHEREAS,Georgetown has communication system resources available
to perform the functions described in the Agreement; and
WHEREAS, Round Rock has a current need for the communications
system resources described in the Agreement; and
WHEREAS, it is mutually advantageous to both parties to enter
into the arrangement evidenced by the Agreement; Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City an Agreement with Georgetown for the use of VHF
Mobile and portable radios, said Agreement being attached hereto and
incorporated herein for all purposes.

STATE OF TEXAS § INTERLOCAL AGREEMENT
§ BETWEEN THE CITY OF GEORGETOWN
COUNTY OF WILLIAMSON § AND CITY OF ROUND ROCK
This Agreement, made and entered into by and between the City of Round Rock, a
homerule municipal corporation, located in Williamson County, hereinafter called 'Round
Rock" and the City of Georgetown, a home rule municipal corporation, located in Williamson
County, hereinafter called "Georgetown," evidences the following:
WHEREAS, Georgetown, and Round Rock desire to enter into an Agreement at the
request of Round Rock for the use of VHF mobile and portable radios hereinafter called
"radios," and
WHEREAS, the Interlocal Cooperation Act, Chapter 771 of the Texas Govemment
Code for any local government to contract with one or more local governments to perform
governmental functions and services under the term of the Act; and
WHEREAS, Georgetown has communication system resources available to perform
the functions described herein; and
WHEREAS, Round Rock has a current need for the communications system resources
described herein; and
WHEREAS, it is mutually advantageous to both parties to enter into the arrangement
evidenced by this Agreement;
NOW, THEREFORE, the parties in consideration of the terms and conditions
contained herein, agree as follows:
The responsibility of each govemmental entity is outlined below:
GEORGETOWN
Georgetown hereby agrees:
1. To furnish Round Rock (o mobile and 0 portable VHF radios for their use,
for a period not to exceed 120 days from the execution of this agreement.
2. To require no monetary consideration for these radios during this period unless
so offered by Round Rock.
3. To accept the return of these radios, at the end of the 120 days period, in the
same conditions as when given to Round Rock.
ROUND ROCK
Round Rock hereby agrees:
1. That it will be responsible for all costs involved in the installation and
programming of these radios.
2. That it will be responsible for any repairs required to these radios during the
period they are in use by Round Rock.
3. To return the radios to Georgetown at the end of the 120 day period in the
same condition as received or, to pay Georgetown for each radio kept, an
amount not to exceed $500.00 per radio.
Georgetown makes no representations and warranties regarding the normal operations
of these radios. Round Rock understands that the performance of any governmental function
is its sole responsibility and does hereby agree to defend, indemnify and hold Georgetown
free and harmless from any and all losses, expenses, liability howsoever caused or arising out
of or in connection with injuries (including death) or damages to any and all persons,
employees and/or property in any way sustained or alledged to have been sustained in
connection with, or by reason of, the performance or failure of any equipment, or the failure
to perform any act or service by employees or agents of the City of Georgetown or the City
of Round Rock or any other person under the terms of this agreement. Round Rock expressly
agrees to indemnify and hold harmless Georgetown whether such claims, losses, damages,
causes of action, and suits of liability arise in whole or part from negligence of Georgetown.
The term of this Agreement shall be for 120 days unless the City of Round Rock
decides to terminate, or both parties mutually agree to change or modify the conditions of this
Agreement.

I have enclosed the Interlocal Agreement between the City of Georgetown and the

you previously received which did not have the signature for the Mayor of Georgetown.

ITEM: 15. A. Consider a resolution authorizing the Mayor to enter into an
intergovernmental agreement with the City of Georgetown for the use of radios.
STAFF RESOURCE PERSON: David Kautz
STAFF RECOMMENDATION:
The City of Georgetown has agreed to allow the City of Round Rock to use portable and
mobile radios in the Round Rock police department. This resolution formalizes the agreement.
These radios operate at our current frequency and provide an interim solution to our radio
communication needs while the 800 Mhz system is being acquired.
There is no cost to the City of Round Rock concerning this agreement.
Staff recommends approval of this agreement.
