BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,

That the Mayor is hereby authorized and directed to execute on
behalf of the City an agreement with the Texas Department of
Transportation for the construction of culverts on FM 3406 at Onion
Creek, a copy of said agreement being attached hereto and
incorporated herein for all purposes.

THIS AGREEMENT is made between the City of Round Rock,
hereinafter called the "City ", acting by and through its duly
authorized Officers and the State of Texas, hereinafter called the
"State ", acting by and through its Texas Transportation Commission.
WHEREAS, the City desires the construction of drainage
improvements on FM 3406 at Onion Creek. The City has requested the
State to construct or have constructed this work on behalf of the
City. The estimated construction cost of this work is Two Hundred
Thirty -two Thousand Five Hundred Seventy -seven and No /100 Dollars
($232,577.00), including contingencies, construction engineering,
preliminary engineering review, and including indirect costs at the
rates in effect for the fiscal years during which the work is
accomplished. The indirect cost rate will be based on the Texas
Department of Transportation's Indirect Cost Plan.

NOW THEREFORE, it is understood that this proposed work will
be constructed by the State and the City will transmit to the State
with the return of this agreement, executed by the City, a warrant
or check made payable to the Texas Department of Transportation in
the amount of Two Hundred Thirty -two Thousand Five Hundred Seventy -
seven and No /100 Dollars ($232,577.00), to be used in paying for
the proposed work required by the City. It is further understood
that the State will construct only those items for the City as
requested and required by the City. In the event it is determined
the funding provided by the City will be insufficient to cover the
State's costs under this agreement, the City will within 30 days
from receipt of the State's written notification provide the
additional funding to cover the State's anticipated additional
costs. In the event the amount as paid is more than the actual
cost of the City's share, as herein established, then the excess
amount will be returned to the City.

Please deliver both copies of this agreement to the City for execution by the responsible city

Once both copies have been executed by the City of Round Rock they should be returned to this
office along with a check or warrant for the dollar amount stated in the agreement.
After both originals of the agreement have been executed by TxDOT, one original copy of the
agreement will be transmitted back to the City for their records.

Pursuant to discussions at our recent meeting, 3406, Ltd. agrees to pay to the City of
Round Rock, $79,040.53 as the remainder of its share of the construction costs for the
culverts at FM 3406. 3406, Ltd.'s share of the construction costs of the culvert is calculated
as follows:
Wood Glen Planned Single Family Area 142 Acres
Regional Stormwater Detention Fee x $800 Per Acre
Total Regional Stormwater Detention Fee for Wood Glen Single Family $113,600.00
Less Amounts Paid:
Phase 1, Section 1, Regional Stormwater Detention Fee $19,113.60
Engineering Fees for Design of FM 3406 Culverts $15,445.87
Balance of Future Regional Stormwater Detention Fees 87. 0480.53
We will provide you with a check for the balance of our share of the culverts, $79,040.53,
within ten (10) days from the date you notify me.
It is our understanding that once you have received the balance of our Regional
Stormwater Detention Fees, the City of Round Rock will submit to the Texas Department of
Transportation the funds for the estimated costs of construction of the culverts together with
the Escrow Agreement as required by TxDOT.
As you know, time is very important to us in the completion of the construction of
these culverts therefore, any thing you can do to expedite this process with TxDOT will be
greatly appreciated.

with the Texas Department of Transportation for the construction of
additional culverts on FM 3406 at Onion Creek.

STAFF RECOMMENDATION:
Currently, storm waters will back up on the north side of FM 3406 at Onion Creek.
When they reach a certain level, the water flows over FM 3406 making travel hazardous.
In conjunction with TxDOT and the developers of the Wood Glen subdivision, the culverts
will be improved to eliminate the highway flooding potential. The cost of the improvements
is estimated at $232,577. The developer agrees to pay $79,040.53 and the balance will
come from regional detention. Staff recommends entering into this agreement with
TxDOT.
