R-95-09-14-10K - 9/14/1995has previously approved the procedure adopted by the Round Rock Independent School District ( "RRISD ") for selling properties acquired by the RRISD in trust for itself and the City of Round Rock through judicial foreclosure of the tax liens pursuant to terms of the Texas Tax Code; and WHEREAS, the RRISD has received bids for the purchase of the west 1/2 of Lot 2, Block 35, Original Town of Round Rock, according to the map or plat thereof recorded in Volume 25, Pages 314 -315, Deed Records of Williamson County, Texas, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed on behalf of the City of Round Rock to execute a tax resale deed for the above described property, a copy of said deed being attached hereto as Exhibit "A ". TO HAVE AND TO HOLD the said premises, together with all and singular the rights, privileges, and appurtenances thereto in any manner belonging unto the said grantee(s), their heirs and assigns forever, so that neither Round Rock Independent School District, Trustee, nor any other taxing unit interested in said tax foreclosure judgment, nor any person claiming under it and them, shall at any time hereafter have, claim or demand any right or title to the aforesaid premises or appurtenances, or any part thereof. SUBJECT however to the following covenant, condition and restriction: (a) The above described realty, or any part thereof, shall not be used in the operation of, or in conjunction with, any school or other institution of learning, study or instruction which discriminates against any person because of his race, color or national origin, regardless of whether such discrimination be effected by design or otherwise. (b) The above described realty, or any part thereof, shall not be used in the operation of, or in conjunction with, any school or other institution of learning, study or instruction which creates, maintains, reinforces, renews, or encourages, or which tends to create, maintain, reinforce, renew or encourage a dual school system. These restrictions and conditions shall be binding upon grantee, R. G. Umstattd or his successors and assigns for a period of fifty (50) years from the date hereof; and in case of a violation of either or both of the above restrictions, the estate herein granted shall, without entry or suit, immediately revert to and vest in the Round Rock Independent School District hereinafter referred to as grantor, and its successor, this instrument shall be null and void, and grantor and its successors shall be entitled to immediate possession of such premises and the improvements thereon; and no act or omission upon the part of grantor herein and its successors shall be a waiver of the operation or enforcement of such condition. The restriction set out in (a) above shall be construed to be for the benefit of any person prejudiced by its violation. The restriction specified in (b) above shall be construed to be for the benefit of any public school district or any person prejudiced by its violation. Taxes for the present year are to be paid by purchasers herein. This conveyance is made expressly subject to recorded restrictive covenants running with the land, and valid easements of record as of the date of this sale, if such covenants or easements were recorded prior to January 1 of the year the tax lien(s) arose. Attempts to collect the ad valorem taxes due on the property have included the delinquent tax collection process, the sheriffs sale process and the above sealed bid process.
