G 40- 03-8- !IT AN ORDINANCE ACKNOWLEDGING RECEIPT OF "CERTIFICATE OF UNOPPOSED STATUS" PURSUANT TO § 2.052 TEXAS ELECTION CODE; DECLARING UNOPPOSED CANDIDATES TO BE ELECTED TO THEIR RESPECTIVE OFFICES AND CANCELING THE MAY 4, 1996 CITY COUNCIL ELECTION; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES. WHEREAS, pursuant to § 2.052 Texas Election Code, the City Secretary, who is also the authority responsible for having the official ballot for City Council elections prepared, has certified in writing that each candidate for office in the May 4, 1996 election is unoppo and WHEREAS, § 2.053 Texas Election Code provides that upon receipt of such a certificate that the Council may declare each unopposed candidate elected to the office, Now Therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: The Round Rock City Council hereby acknowledges receipt of a Certificate of Unopposed Status from the City Secretary that each candidate whose name is to appear on the ballot for the May 4, 1996 City Council election is unopposed. A copy of such Certificate is ordered to be attached to this ordinance as an exhibit. II. Pursuant to § 2.053 Texas Election Code, the City Council hereby declares that each of the following unopposed candidates are elected to their respective offices: a) Charlie Culpepper b) Robert Stluka c) Earl Palmer C \WPOcs\ORDhiOvc\onco,cez ¢ee /s\e Mayor, City of Round Rock City Council, Place 1 City of Round Rock City Council, Place 4 City of Round Rock Pursuant to § 2.054, the City Council election previously scheduled for May 4, 1996 is hereby canceled, and it is ordered that a copy of this ordinance be posted on election day at each polling place that would have been used in the election. IV. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. Alternative 1. The Round Rock Independent School District has already signed the agreement and now it needs your signature. Please return a copy of the contract to the School District after you have signed it. As you know, the City of Round Rock was fortunate enough to be able to take advantage of a new State law which states that no election has to be held if all candidates are unopposed, there are no declared write -ins and there are no propositions on the ballot. We are one of the first cities in the State to utilize the law. Eventhough, we will not be participating in the May 4th election, I will be happy to continue being the Custodian of Election Records for the election as noted under 2.e. of the Election Services Contract.
