RESOLUTION NO. R- 96- 03- 14 -10D
WHEREAS, the City of Round Rock desires to have engineering
services for improvements for a portion of County Road 122, and
WHEREAS, Baker - Aicklen & Associates, Inc., has submitted an
agreement to provide said engineering services, and
WHEREAS, the City Council desires to enter into said agreement
with Baker - Aicklen & Associates, Inc., Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City an agreement with Baker - Aicklen & Associates, Inc.,
for engineering services for improvements for a portion of County Road
122, a copy of said agreement being attached hereto and incorporated
herein for all purposes. tt

Engineering Services for Interim Improvements
Dear Mr. Nuse:

We are pleased to submit this proposal to provide the necessary engineering and surveying
services for the development of plans and specifications for interim roadway improvements to
County Road 122 in Round Rock, Texas.
The project will consist of widening improvements to County Road 122 from U.S. Highway 79 to
Gattis School Road as well as intersection improvements at Forest Creek Drive.
Below is a more specific list of our proposed Scope of Services and Basis of Compensation:
SCOPE OF SERVICES
A. FIELD RECONNAISSANCE AND SURVEYING
1. Collect and review pertinent data .
2. Assign survey crew to collect existing topographic information at the
County Road 122/Forest Creek intersection. Topo to extend 500 feet
north, south, and east of intersection. Topo shall extend westerly a
sufficient distance to adequately portray the geometrics of the intersection.
Additional surveying may be provided at intersections when it is deemed
appropriate by the City of Round Rock and the Engineer.
3. Investigate existing surface condition, existing width, available widening
space, and sight distances along remainder of roadway.
4. Investigate existing drainage structure width and alignment for potential
widening.

B. PREPARATION OF WIDENING PLAN
1. Using data collected above, prepare plan and specifications for widening of
County Road 122.
2. Prepare plan and profile for reconstruction of County Road 122/Forest
Creek Drive intersection. Plans to include the construction of the second
half of Forest Creek Drive for a distance of 500 feet + .
3. Meet with City of Round Rock to discuss proposed widening and
reconstruction.
4. Utilizing input from meeting, and finalize project plans and specifications.
5. Submit final project documents to City of Round Rock for review.
6. Revise project documents as needed to secure approval.
7. Prepare Engineers Opinion of Probable Cost.
C. CONSTRUCTION PHASE SERVICES
1. Prepare bid/contract documents.
2. Distribute plans and specifications to prospective bidders. Plans and
specifications reproduction and distribution costs are to be considered
reimbursable expenses
3. Assist in securing and analyzing bids.
4. Make recommendation of award.
5. Assist in preconstruction conference.
6. Review shop drawings.
7. Visit construction site periodically.
8. Interpret drawings and specifications.
9. Observe construction for general conformity to contract documents (not
full -time representation).
10. Review Contractor's pay estimates.
11. Prepare final punch list.
12. Issue Contractor's Certificate of Completion.

Do to the uncertainty of the services involved, we propose to provide the above -
described Scope of Services on an hourly- charge plus reimbursable- expense basis.
The hourly rate will be in accordance with the attached hourly rate sheet. Below is
a listing of our estimation of the costs for the different major items of work:

These estimated amounts are not to be considered maximums; however, we will
agree not to exceed the total estimated amount without prior authorization. You
will be advised as to the status of our charges and budget. Should it appear that
these estimated amounts will be exceeded, subsequent request for additional
authorization will be made in advance. Not included in the above estimates are the
following: drainage work; structural design (walls over 3 feet in height);
sedimentation/filtration basin design; detention pond design; geotechnical and
testing lab services; trench safety design, landscape & sprinkler system design;
endangered species survey; karst surveys; archaeological and geological surveys;
T.I.A. reports or other special studies, if required; and fees charged by
City/TNRCC. The firm's professional liability is limited to the total amount of
compensation up to a maximum of $50,000.00.
If this proposal is acceptable, please endorse the enclosed agreement and return a copy to our
office for our files. We are prepared to commence work immediately upon your authorization.

PROFESSIONAL SERVICES AGREEMENT
City of Round Rock, as Client, engages Baker- Alcklen & Associates, Inc. as ENGINEER to perform professional services for the
assignment described as follows:
Site work engineering for the proposed Widening of County Road 122 in Round Rock, Texas. See attached letter proposal No. 96-053
dated 3/5/96.
1 SERVICES: ENGINEER agrees to perform in conformance with the following description, definition, terms and conditions.
See attached letter proposal No. 96-053 dated 3/5/96.
II. COMPENSATION: Engineers compensation will be on an hourly- charge basis for personal services (defined below) plus
Reimbursable Expenses (defined below):
A. HOURLY CHARGE: Hourly charges are to be based on the current Standard Rate Schedule effective at the time of billing.
The current Standard Rate Schedule effective April 1, 1993, Is attached.
B. REIMBURSABLE EXPENSES: Reimbursable Expenses shall include transportation and subsistence of personnel while
traveling in connection with the work, field office expenses, long distance telephone calls, telegrams, reproduction expenses,
subcontracts and similar items. Such expenses shall be reimbursed at the following rates:
1. Transportation by ENGINEER'S vehicles: at ENGINEER'S standard rates if destination exceeds a 50 -mile radius of
ENGINEER'S office.
2. Reproduction rformed in ENGINEERS office: at prevailing commercial rates.
3. All others: actual cost to ENGINEER plus 10% service charge.
4. Where field parties are used, expenses shall Include charges for the use of any special Instruments and equipment,
Including marine equipment, and expendable Items such as stakes and monuments.

IV. OWNERSHIP OF DOCUMENTS: All documents, including original drawings, estimates, specifications, field notes and data are
and shall remain the property of ENGINEER. CLIENT may at his expense obtain a set of reproducible record copies of drawings
and other documents, but agrees that he will use such copies solely in connection with the project covered by this Agreement and
for no other purpose.
V. INSURANCE: ENGINEER agrees to maintain workmen's compensation insurance to cover all of its own personnel engaged In
performing services for CLIENT under this Agreement. ENGINEER also agrees to maintain public liability insurance covering
claims against ENGINEER for damages resulting from bodily injury, death or property damage from accidents arising In the
course of services perforated under this Agreement.
VI. LIABILITY LIMITATION' ENGINEER shall have no liability to CLIENT or to others as a consequence of express or Implied
approval of any construction activities, for any defective construction (whether or not observed or approved by ENGINEER), for
any excess of construction costs over an amount estimated, or for any other reason beyond warranty of the use of reasonable skill
In the preparation of particular drawings and designation of particular materials for the assignment covered by this Agreement. In
no event shall ENGINEER'S professional liability exceed the amount of total compensation received by ENGINEER under this
Agreement, limited to a maximum of $50,000.
VII. TERMINATION:
A. CONDITIONS OF TERMINATION. This Agreement may be terminated without cause or at any time prior to completion of
ENGINEER'S services either by CLIENT or by ENGINEER, upon seven days written notice to the other at the address of
record. Termination shall release each party from all obligations of this Agreement, except as specified In paragraph VII.B
below.
B. COMPENSATION PAYABLE ON TERMINATION: On termination, by either CLIENT or ENGINEER, CLIENT shall pay
ENGINEER the full amount specified in paragraph II, with respect to any Engineering Services performed to date of
termination (Including all Reimbursable Expenses Incurred).
VIII. SUCCESSORS AND ASSIGNS: CLIENT and ENGINEER each binds himself, and his partners, successors, executors,
administrators and assigns to the other party of this Agreement and to the partners, successors, executors, administrators and
assigns of such other party in respect to all covenants of this Agreement. Neither CLIENT nor ENGINEER shall assign, sublet, or
transfer his interest in this Agreement without written consent of the other. Nothing herein shall be construed as giving any rights
or benefits hereunder to anyone other than CLIENT and ENGINEER
IX. SPECIAL PROVISIONS: This Instrument contains the entire Agreement between CLIENT and ENGINEER, except as
additionally stated below:
Attached letter proposal No. 96-053 dated 3/5/96 forms a part of this agreement
X. INVALIDATION: If this agreement Is not executed by CLIENT within 30 days of the date tendered, it shall become invalid unless
ENGINEER extends the time In writing.
XI. MODIFICATIONS: No one has authority to make variations in, or additions to the terms of this Agreement on behalf of
ENGINEER other than one of Its Officers, and then only in writing signed by him

3. A minimum of two (2) hours field party time charge will be made for show -up
time and return to office, resulting from inclement weather conditions,
etc.

ITEM: 10D. Consider a resolution authorizing the Mayor to enter into an
engineering design proposal agreement with Baker - Aicklen and
Assoc., Inc. for a portion of County Road 122.
STAFF RESOURCE PERSON: Jim Nuse
STAFF RECOMMENDATION:
County Road 122 is changing in character. Not only is through traffic increasing,
the area is experiencing rapid development. A new elementary school will be opening
this fall which will dramatically add to existing traffic congestion. As part of the recent
bond election, a detailed study to establish right of way requirements and alignment has
been undertaken. Shared funding options are being explored but it does not appear that
CR 122 will be improved to its' ultimate section any time soon. Several measures are
being considered to improve these conditions in the near term:
• Work with Williamson County to improve the shoulders and driving surface
within the current alignment.
• Improve the cross - section of CR 122 at the intersection of Forest Creek
Dr. and Double Creek Dr. This improvement will include widening of CR
122 to accommodate turning movements into and out of these subdivisions.
An additional lane will be constructed on Forest Cr. Dr. This additional lane
will complete the ultimate alignment of the intersection. We will make every
effort to make as many of these improvements conform to the final cross
section so they can remain when CR122 is ultimately improved.
• Signage and signalization will be improved. The first step is a speed study
to determine the posted speed limits for CR122. Once the study is in place,
a signage plan will be prepared to include recommendations for speed limit
sign placement, school zone signage, and traffic control such as stop signs
or traffic signals.
• Sidewalks, crosswalks, and street lighting will be improved or established.
Existing sidewalks will be extended and crosswalks established at
appropriate locations. A street lighting plan along Forest Creek Dr. is being
prepared by TU.
