THIS AGREEMENT is made between the City of Round Rock
hereinafter called the "City ", acting by and through its duly ,
authorized Officers and the State of Texas, hereinafter called
the "State ", acting by and through its Texas Transportation
Commission.
WHEREAS, the City desires drainage improvements to SH 79 at
Provident Street. The City has requested the State to construct
or have constructed this work on behalf of the City. The cost of
this work is Eighty one Thousand Four Hundred Eighty Three and
19/100 dollars, ($81,483.19) which includes
construction, construction engineering, and indirect costs.
Indirect costs will be based on the Texas Department of
Transportation's Indirect Cost Plan for the fiscal year during
which the work is accomplished. If at anytime during the
construction of the work requested by the City, it is determined
that the acquisition of right -of -way and /or relocation of
utilities will be required, the City shall be solely responsible
for the cost associated with the aforementioned acquisition
and /or relocation, to the extent the utility provider does not
pay for such cost.
NOW THEREFORE, it is understood that this proposed work, if
approved for inclusion into an existing construction contract by
change order by the State, will be constructed by the State and
the City will transmit to the State with the return of this
agreement, executed by the City, a check made payable to the
Texas Department of Transportation in the amount of Eighty one
Thousand Four Hundred Eighty Three and 19/100 Dollars
($81,483.19), to be used in paying for construction engineering,
indirect and construction costs.

WHEREAS, there is an existing drainage problem along U.S. 79
between Provident Lane and F.M. 1460, and
WHEREAS, the Texas Department of Transportation ( "TxDot ") is
proposing the construction of storm pipes and inlets to pipe the
storm water to Brushy Creek in order to correct the problem, and
WHEREAS, TxDot is requesting that the City pay for the cost
of the pipe from the U.S. 79 right -of -way to Brushy Creek, Now
Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City an agreement with TxDot to pay the City's share
of the drainage project as outlined above, the terms of said
agreement to be subject to the approval of the Director of Public
Works and the City Attorney.

ITEM: 10K. Consider a resolution authorizing the Mayor to enter into an
agreement with the Texas Department of Transportation for drainage
improvements along Highway 79 between Provident Lane and FM
1460.
STAFF RESOURCE PERSON: Jim Nuse
STAFF RECOMMENDATION:
There is an existing drainage problem along highway 79 between Provident Lane
and 1460. In order to resolve the problem, the highway department is proposing the
construction of storm pipes and inlets to pipe the water to Brushy Creek. The City is
requested to pay for the piping between Brushy Creek and the highway right -of -way.
Attached is cost sheet from TxDOT for our share of the improvements. The total is
$82,416. These funds will be paid from regional detention. We request that the mayor
be authorized to execute the agreement after it is approved by the City Attorney.
