R-96-09-12-10B - 9/12/1996WHEREAS, the City of Round Rock desires to retain professional lobbying services, and WHEREAS, McKinley, Smith & Seale has submitted an agreement to provide said services, and WHEREAS, the City Council desires to enter into said agreement with McKinley, Smith & Seale, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City an agreement with McKinley, Smith & Seale, for professional lobbying services, a copy of said agreement being attached hereto and incorporated herein for all purposes. R- 96- 09- 12 -10B CHARLES CULPE'PER, Mayor City of Round Rock, Texas Peggy Smith, a registered lobbyist, and her firm, McKinley, Smith and Seale, will provide the following professional services to the City of Round Rock: • Assist in the formulation of a Legislative Action Plan for the 75th Texas Legislative Session; • Directly communicate Round Rock policy positions to members of the Legislature, staffs of legislators and administrative personnel; • Assist in the introduction and process of legislative initiatives during the session; • Inform members of the Legislature of provisions of proposed or pending legislation which Round Rock opposes due to negative or adverse impact; • Prepare witnesses and assist with the scheduling of witnesses before legislative committees; • Monitor pending and proposed legislation affecting Round Rock; and • Perform such other services including, but not limited to, representing Round Rock before ATS, TXDOT and other governmental agencies as requested by Round Rock. In return for the provision of above described services the City of Round Rock will pay to McKinley, Smith and Seale the following sums: 70-v $2,000 initial retainer upon contract date and $2,000 p r month, plus expenses, beginning September 12, 1996. As of January 1, 199 , Round Rock will pay $3,000 per month, plus expenses, during the remainder of the five month legislative session. Expenses are defined as out of pocket expenses for copying, phone charges, and other ordinary occurrences. Any expense over $100 will be approved prior to charge. After discussing this with Councilmember Stluka and Steve Sheets. I am providing an outline of services and issues for your consideration. I believe our services best complement public relations or communications. While representing the City during the 75th Legislative Session, 1 encountered several important Items which remain yet to be completed. Of particular importance to the City are: federal and state funding for major transportation projects in this area, coordination of the newly created tollroad division of TxDOT, implementation of the commuter rail district and local decisions regarding a possible regional tollroad authority. Actions during the upcoming months of August through October will be especially important for the City. Several opportunities are scheduled which include meetings with US Senators. congressmen Secretary of Transportation and the Texas Transportation Commission members. The types of services to be performed by our firm could include the following: • Preparation, coordination and release of news releases and other communications. • Liaison with Senators' Wentworth, Ogden; Rep. Krusee, Congressmen Smith and Paul; and Senators' Gramm and Hutchison. Liaison with key state and federal administrative personnel, Planning, coordination and execution of meetings with Legislators, agency heads and city officials. Monitor appropriate agency board and commission meetings. Assisting in the development of the city's legislative agenda. Current major transportation projects include SH45, Loop1, SH 130, and the intersection of FM1325 and IH35. In addition to transportation matters described above, the firm will provide the following: • Preparation, coordination and release of news releases, letters, resolutions, proposals and other communications. • Liaison with Senators' Wentworth, Ogden; Rep. Krusee, Congressmen Smith and Paul; and Senators' Gramm and Hutchison. • Liaison with key state and federal administrative personnel. • Planning, coordination and execution of meetings, events, press conferences, hearings, followup writing campaigns, etc. with legislators, agency heads and city officials. Monitor appropriate agency board and commission meetings. Assist with developing the city's legislative agenda. Peggy Smith, as principal, and McKinley, Smith and Seale will provide the above described services for 52,000 due at the time of contract date and $75 per hour (billed at quarter hour increments), with a 20 hour per month guaranteed, plus expenses'. MSS shall issue a monthly statement to the City. 'Expenses shall include costs to MSS for printing, copying, long distance charges, travel and costs directly associated with projects. Singular expenses in excess of $200 shall be approved in advance.
