WHEREAS, the City of Round Rock desires to retain engineering
services for Lake Creek Watershed Utilization of the Austin White
Lime Quarry, and
WHEREAS, Baker - Aicklen & Associates, Inc. has submitted an
agreement to provide said services, and
WHEREAS, the City Council desires to enter into said
agreement with Baker - Aicklen & Associates, Inc., Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City an agreement with Baker - Aicklen & Associates,
Inc., for Lake Creek Watershed Utilization of the Austin White Lime
Quarry, a copy of said agreement being attached hereto and
incorporated herein for all purposes.

PROFESSIONAL SERVICES AGREEMENT
City of Round Rock, as Client, engages Baker- Aickten & Associates, Inc. as ENGINEER to perform professional services for the
assignment described as follows:
Site work engineenng for the proposed Lake Creek Watershed, Utilization of Austin White Lime's Quarries, Round Rock, Texas. See
attached letter proposal No. 975010 dated 2/6/97.
I. SERVICES: ENGINEER agrees to perform in conformance with the following descnption, definition, terms and conditions

II COMPENSATION: Engineers compensation will be on an hourly-charge basis for personal services (defined below) plus
Reimbursable Expenses (defined below):
A. HOURLY CHARGE' Hourly charges are to be based on the current Standard Rate Schedule effective at the time of billing.
The current Standard Rate Schedule effective Apnl 1, 1993, is attached
B. REIMBURSABLE EXPENSES: Reimbursable Expenses shall include transportation and subsistence of personnel while
traveling in connection with the work, field office expenses, long distance telephone calls, telegrams, reproduction expenses,
subcontracts and similar items. Such expenses shall be reimbursed at the following rates:
1. Transportation by ENGINEERS vehicles: at ENGINEERS standard rates if destination exceeds a 50.mile radius of
ENGINEERS office.
2 Reproduction performed In ENGINEERS office: at prevailing commercial rates.
3. All others: actual cost to ENGINEER plus 10% service charge.
4 Where field parties are used, expenses shall include charges for the use of any special instruments and equipment,
including marine equipment, and expendable items such as stakes and monuments
III. PAYMENTS: ENGINEER will invoice CLIENT semi-monthly for all current amounts eamed under this Agreement. CLIENT
agrees to promptly pay ENGINEER at his office in Travis County, Texas, the full amount of each such invoice upon receipt. A
charge of 1.596 per month will be added to the unpaid balance of Invoices not paid within 30 days after date of invoice.
IV. OWNERSHIP OF DOCUMENTS: All documents, Including anginal drawings, estimates, specifications, field notes and data are
and shall remain the property of ENGINEER CLIENT may at his expense obtain a set of reproducible record copies of drawings
and other documents, but agrees that he will use such copies solely in connection with the project covered by this Agreement and
for no other purpose
V. INSURANCE: ENGINEER agrees to maintain workmen's compensation Insurance to cover all of its own personnel engaged in
performing services for CLIENT under this Agreement. ENGINEER also agrees to maintain public liability Insurance covenng
claims against ENGINEER for damages resulting from bodily Injury, death or property damage from accidents arising in the
course of services performed under this Agreement.
VI. i : ITY LIMITATION: ENGINEER shall have no liability to CLIENT or to others as a consequence of

B. COMPENSATION PAYABLE ON TERMINATION: On termination, by either CLIENT or ENGINEER, CLIENT shall pay
ENGINEER the full amount specified in paragraph II, with respect to any Engineering Services performed to date of
termination (including all Reimbursable Expenses incurred).
VIII SUCCESSORS AND ASSIGNS' CLIENT and ENGINEER each binds himself, and his partners, successors, executors,
administrators and assigns to the other party of this Agreement and to the partners, successors, executors, administrators and
assigns of such other party in respect to all covenants of this Agreement. Neither CLIENT no ENGINEER shall assign, sublet, or
transfer his interest in this Agreement without wntten consent of the other. Nothing herein shall be construed as giving any rights
or benefits hereunder to anyone other than CLIENT and ENGINEER.
IX. SPECIAL PROVISIONS: This Instrument contains the entire Agreement between CLIENT and ENGINEER, except as
additionally stated below:
Attached letter proposal No. 97-5010 dated 2/6/97 forms a part of this agreement.

Lake Creek Watershed, Utilization of Austin White Lime's Quarries
We are pleased to submit our proposal for services related to the above referenced
project. Basically, our proposal provides for the survey and the hydrology analysis of the
Lake Creek Watershed in Williamson County utilizing Austin White Lime's quarries as
detention ponds. Below is a more specific list of our proposed Scope of Services and
Basis of Compensation:
A. DATA COLLECTION
SCOPE OF SERVICES
B. SURVEY DATA COLLECTION
B -A Proposal No. 97 -5010
1. Assemble and review pertinent data.
2. Meet with Client to discuss objectives, special criteria and schedules.
3. City of Round Rock to provide a copy of the HEC1 data of the "Flood
Plain Hydrology Study of Upper Brushy Creek Watershed" by
Hydrosystems Engineering Inc. (June 1987 - Dr. Larry Mays, P.E.).
4. Obtain Texas Highway Department's proposed alignment of State
Highway 45.
1. Provide survey crew to set approximately 12 panel points for aerial
photography of an area primarily consisting of the Robinson land
westerly of the City of Round Rock (see sketch to this proposal)
2. Furnish survey crew to establish horizontal coordinates and vertical
datum on each panel point.
3. Provide office support for field operations and technical coordination
with aerial flight company.

4. Obtain final aerial photography product at a scale of 1" =400' depicting
2 foot contours.
5. Supplement contour map provided by aerial company with "limited"
on- the - ground survey verification of critical areas to assist with design
phase of project.
C. PRELIMINARY HYDROLOGY STUDY REPORT
1. Using the hard copy of Larry May's HEC1 for Lake Creek Watershed
with Diversions, as the base model (Snyder Unit Hydrograph, SCS
curve numbers, SCS Type II 10 -yr. (4.49 ") & 25 -yr. (5.51 ") storm
events), enter the data from the hard copy into electronic format.
2. Digitize the Lake Creek Watershed and all of the sub -basins so that it
can be overlaid with the 1" =400' aerial photo.
3. Enter or digitize State Highway 45 proposed alignment (1 "= 400').
4. Modify the base model to reflect the re- routing of flows from one
quarry to another and the proposed State Highway 45 alignment.
5. Prepare a "Preliminary Hydrology Study" report comparing the
differences in flow rates between the two models at each cross - section.
6. Prepare a limited HEC2 model (approx. cross - sections 5 - 11) to
compare water surface elevations between the base HEC2 model and
the modified model.
7. Prepare a preliminary cost estimate of the proposed modifications.
BASIS OF COMPENSATION
We propose to provide the above - described Scope of Services as indicated below. Hourly
rates will be based upon the attached hourly rate sheet. For budget purposes, we estimate
our charges to be as shown below:

* This fee is based upon a price quote from "Land Data Geo. Services ", San
Antonio, TX. This cost will be a "pass through" to the City of Round Rock.
Should we be able to procure this topographic mapping from the firm
currently flying the area for the G.I.S. mapping project, any cost savings will
be passed on the City of Round Rock.
The above estimated amounts are not to be considered maximums; however, we will agree
not to exceed the total estimated amount without prior authorization. You will be advised
as to the status of our charges and budget. Should it appear that these estimated amounts
will be exceeded, subsequent request for additional authorization will be made in advance.
The estimated amount does not include sales tax which is mandated by State law on
certain types of surveys. The Firm's professional liability is limited to the total amount of
compensation not to exceed $50,000.00.
If this proposal is acceptable, please endorse the enclosed agreement and return a copy to
our office for our files. We are prepared to commence work immediately upon your
authorization.

STAFF RECOMMENDATION:
For over a decade, the City has relied on several quarries at Austin White Lime to
reduce the quantity of flow in Lake Creek. Austin White Lime is interested in continuing
the use of quarries for detention but are interested in minimization of land required. Both
Austin White Lime and the City of Round Rock agree that Baker - Aicklen are appropriate
for the work. The aerial surveying item in the agreement may not be required if the
CAPCO aerial work is complete in a timely manner.
