WHEREAS, Sierra Environmental Solutions has submitted an
agreement to provide said services, and
WHEREAS, the City Council desires to enter into said
agreement with Sierra Environmental Solutions, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City an agreement with Sierra Environmental Solutions
for professional services to provide asbestos abatement for the
demolition of a four -unit apartment building at 205 E. Liberty, a
copy of said agreement being attached hereto and incorporated
herein for all purposes.

THIS AGREEMENT is entered into on this the DATE JULY 1 0,1997 , between the
OWNER, CITY OF ROUND ROCK, and the CONTRACTOR, SIERRA ENVIRONMENTAL
SERVICES INC., P. O. BOX 151238, AUSTIN, TX 78215 -1238 for the following PROJECT:
A TWO STORY APARTMENT BUILDING
Round Rock, Texas
I.
THE CONTRACT DOCUMENTS
The Contract Documents consist of this Agreement and any Exhibits attached hereto, Conditions
of the Contract (General, Supplementary, and other Conditions), Bidding Documents, Drawings,
Specifications, all Addenda issued prior to execution of this Agreement and all Modifications
issued subsequent thereto. These form the Contract, and all are as fully a part of the Contract as
if attached to this agreement or repeated herein. Unless otherwise specified, definitions set forth
in the General Conditions apply to all other Contract Documents.
IL
THE WORK. ;,
The Contractor shall perform all the Work required by the Contract Documents, for: Asbestos
Abatement Project at a Two Story apartment Building, Round Rock, Texas.
IIL
COMMENCEMENT AND COMPLETION
The Work to be performed under this Contract shall be commenced upon issuance of notice to
proceed, and, subject to authorized adjustments, Substantial Completion for all bid items shall be
achieved not later than DATE OF SUBSTANTIAL COMPLETION.
Should the CONTRACTOR fail to substantially complete the Work on or before the date
stipulated for Substantial Completion (or such latter date as may result from extension of time
granted by the OWNER), he shall pay the OWNER, as liquidated damages, the sum of:
LIQUIDATED DAMAGES: $1,000 per day
for each consecutive calendar day that terms of the Contract remain unfulfilled beyond the date
allowed by the Contract, which sums are agreed upon, not as a penalty, but as reasonable and

proper measures of damages which the OWNER will sustain per day by failure of the
CONTRACTOR to complete all Work within the time as stipulated; it being recognized by the
OWNER and the CONTRACTOR that the injury to the OWNER, including the lost use of the
facilities, attendant disruption to the educational system, and the extended administrative
resources, which could result from a failure of the CONTRACTOR to complete on schedule, is
uncertain and cannot be computed exactly.
Construction work shall be started on July 21. 1997 and completed on July 25. 1997.
IV.
CONTRACT SUM
The OWNER shall pay CONTRACTOR for the performance of the Work, subject to additions
and deductions by Change Order as provided in the Conditions of the Contract, in current funds,
the Contract Sum of: AMOUNT OF CONTRACT.
Base Bid: AMOUNT: Six thousand four hundred twenty dollars ($6,420.00)

V.
PAYMENTS
Based upon applications of payment submitted to the Consultant by the CONTRACTOR and
Certificates for Payment issued by the Consultant, the OWNER shall make progress payments on
account of the Contract Sum to the Contract as provided in the Conditions of the Contract as follows:
On or about the first of each month, ninety -five (95 %) percent of the portion of the Contract Sum
properly allocable to labor, materials, and equipment incorporated in the Work, and ninety-five 95 %)
percent of the portion of the Contract Sum properly allocable to materials and equipment suitably
stored at the site or at some other location agreed upon in writing by the parties up to ten (1 0) days
prior to the date on which the application for payment is submitted, less the aggregate of previous
payments in each case; and upon Substantial Completion of the entire Work, a sum sufficient to
increase the total payments to ninety-five (95 %) percent of the Contract Sum, less such retainage as
the Consultant shall determine for all incomplete Work and unsettled claims.
Final payment, constituting the entire unpaid balance of the Contract Sum, shall be paid by the
OWNER to the CONTRACTOR thirty (30) days after Substantial Completion of the Work unless
otherwise stipulated in the Certificate of Substantial Completion, provided the Work has been
completed, the Contract fully performed, and a final Certificate of Payment has been issued by the

Consultant.
Any monies not paid when due to either party under the Contract shall bear interest at the legal rate
in force at the place of the PROJECT.

Hazardous waste material was discovered in the four twit two story apartment project
purchased from Garfield McConico. This building is planned to be demolished for the
expansion of the Library. Asbestos abatement of vinyl flooring and textured ceilings
was bid by invitation on June 17, 1997. We received five quotes from the six invited
and they are as follows.

After reviewing the qualifications Greenleaf Labs, Inc. the consulting firm and myself
