R- 97- 07- 24 -10B WHEREAS, the City of Round Rock desires to retain engineering services for platting the properties that front on the limits of the East Main Street Improvement Project, and WHEREAS, Martinez, Wright & Mendez, Inc. has submitted an agreement to provide said services, and WHEREAS, the City Council desires to enter into said agreement with Martinez, Wright & Mendez, Inc., Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City an agreement with Martinez, Wright & Mendez, Inc., platting the properties that front on the limits of the East Main Street Improvement Project, a copy of said agreement being attached hereto and incorporated herein for all purposes. Plat will include the dedication of street right -of -way and will be prepared in accordance with the. City of Round Rock Preliminary and Final 'Plat requirements. , 4 Client will be responsible for acquiring right -of -entry to subject tracts., - 5. Client will be responsible for all fees related to preliminary and final plat submissions. 2. Provide field notes, closure and area calculation of area to be platted. ': Horizontal control will be on an arbitrary basis. Vertical control will be on 'City of Round Rock basis Services can begin as soon as written authorization is received and can be completed in about 30 work days (predicated upon suitable weather conditiohs). - , Martinez, Wright & Mendez, Inc. propose to provide the professional services outlined above for an . '- amount not to exceed $5,800.00. Payment for services under this agreement will be due within 30 days from receipt of invoice. The fee breakdown is shown on Attachment "A" dated 5/19/97. • . Excluded Services - - Services that are ngt provided under this Agreement specifically include, but are not limited to: hydrologic study to determine the 25 year flood elevation (100 year flood plain will be shown from FEMA Flood Insurance Rate Map); engineering services for proposed water, wastewater, drainage or roadway design; land acquisition services; easement acquisition or vacation; construction phase surveying; bore hole staking or locating; and other services or expenses which may become necessary for the completion of this project , but which are not reasonably anticipatable at this time. Such services may be performed as Additional Services to this Agreement, if authorized by Client. - ' General Conditions In connection with all the work outlined or contemplated above, it is agreed that Martinez, Wright & Mendez, - Inc. or client may cancel or terminate this Agreement upon seven (7) days written notice to the other, with the provisions and understanding that immediately upon receipt of notice of such cancellation from either party to the other all work and labor being performed under this Agreement shall immediately cease, pending final cancellation at the end of such seven day period, and further provide that the Martinez, Wright & Mendez, Inc. shall be compensated in accordance with the terms of this Agreement for all work accomplished, by them prior to the receipt of notice of such termination. Mailing expense for certified mail receipts and cards for "Return Receipt Requested" mail to all property owners within 200' of property to be subdivided. - The Agreement, including these terms and conditions, represents the entire Agreement between Client and MWM and supersedes all prior negotiations, representations, or agreements, wntten or oral. The Agreement may be amended only by written instrument signed by the Client and Martinez, Wright & Mendez, Inc. The land surveying services provided by Martinez, Wright & Mendez, Inc. are regulated by the Texas Board of Land Professional Land Surveying, 7701 N. Lamar Blvd., Suite 400, Austin, Texas 78752, (512) 452 -9427. This proposal is valid for a period of 30 days from date of proposal. Inc. for platting the properties that front on the limits of the East Main Street Improvement Project. STAFF RESOURCE PERSON: Jim Nuse The East Main Street Improvement Project is a part of the 1996 General Obligation Bond Package. Part of the process to accomplish these improvements is the dedication of the existing roadway as public right -of -way. The platting process will accomplish this dedication as well as making the parcels legal Tots as a step toward water and wastewater service to these tracts. Staff recommends approval.
