R- 97- 09- 25 -13Q WHEREAS, the City of Round Rock, on April 10, 1997, entered into a contract ( "Contract ") with Baker - Aicklen & Associates, Inc. for surveying services, and WHEREAS, Baker - Aicklen & Associates, Inc. has submitted Amendment No. 1 to the Contract to extend the termination date of the Contract, and WHEREAS, the City Council desires to enter into said Amendment No. 1 to the Contract with Baker - Aicklen & Associates, Inc., Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Amendment No. 1 to the Contract with Baker - Aicklen & Associates, Inc. to extend the termination date of the Contract, a copy of said amendment being attached hereto and incorporated herein for all purposes. I f l1o AlAi ' LAND, Cit Secretary R:\ WPOQCS \RRSOLllTI \RS7D92SQ.WPD /RCg CHAR CUL / PI PPER, Mayor City of Round Rock, Texas THE STATE OF TEXAS THE COUNTY OF WILLIAMSON AMENDMENT NO. 1 TO CONTRACT FOR SURVEYING SERVICES This Amendment to the Contract for Surveying Services is made by and between the City of Round Rock, Texas, hereinafter called the "City" and Baker - Aicklen and Associates, Inc., hereinafter called the "Surveyor," WHEREAS, the City and the Surveyor executed a Contract for Surveying Services, hereinafter called the "Contract ", on the 10th day of April, 1997, and WHEREAS, the Surveyor has provided quality service to the City through this Contract, and WHEREAS, Article 1, Contract Period, requires termination of the Contract on September 30, 1997 unless the Contract is extended, and WHEREAS, it is in the City's best interest to extend the term of the Contract until September 30, 1998, and WHEREAS, the Surveyor has agreed to extend the Contract until September 30, 1998 under the existing terms and conditions. NOW THEREFORE, premises considered, the City and the Surveyor agree that said Contract is amended as follows "Article 1 CONTRACT PERIOD" shall be amended by extending the termination date of the Contract to the close of business on September 30, 1998. That contract established the maximum amount payable under the contract as $50,000.00 unless amended. The contract further sets the contract expiration date at September 30, 1997 unless the contract period is extended. As of September 8, 1997 Baker - Aicklen & Associates, Inc. has invoiced $12,712.08 under this contract. By copy of this letter Baker - Aicklen & Associates, Inc. offers to extend this contract, under the existing terms and conditions for an additional year, that is until September 30, 1998. Consider a resolution authorizing the Mayor to execute Amendment No. 1 to extend the termination date of the surveying contract with Baker - Aicklen & Assoc., Inc. STAFF RESOURCE PERSON: Jim Nuse STAFF RECOMMENDATION: The City of Round Rock entered into a contract with Baker - Aicklen and Associates, Inc. on April 10, 1997. The contract was for surveying services to be provided by the Surveyor on an as needed basis as assigned through work orders issued by the City. The existing contract had a maximum amount payable of $50,000. The term of the existing contract expires on September 30, 1997. To date, Baker - Aicklen has invoiced the City for $12,712.08 through this contract. The contract has proven to be a very useful tool for the City to obtain needed surveying information in an expedited manner. The quality of the product provided has been good. Baker - Aicklen has requested that the term of the existing contract be extended for a year from September 30, 1997 to September 30, 1998. All other terms of the existing contract would remain the same, including the hourly rates for services and maximum amount payable of $50,000. Staff believes that it is in the City's best interest to extend the termination date of the contract, and recommends your approval of this Contract Amendment No. 1.
