INTERLOCAL COOPERATION CONTRACT
THIS CONTRACT AND AGREEMENT is entered into by and between the General
Services Commission, an agency of the State of Texas, and the City of Round Rock, a
political subdivision of the State of Texas, under authority of the Interlocal Cooperation
Act, Texas Government Code, Chapter 791.
I. CONTRACTING PARTIES

Chapter 2258, Texas Government Code, requires a public body to either conduct
a survey to determine the prevailing wage or adopt rates as determined by the
U.S. Department of Labor for public works projects of the public body. The
Performing Agency, GSC, agrees to provide the Receiving Entity, the City of
Round Rock, a prevailing wage determination based on a survey for its relevant
locality, upon the request of the Receiving Entity.
The Receiving Entity shall request a prevailing wage determination prior to
contracting for a public works project.
City
During the initial term of this Contract, the Cranny shall pay GSC Zero Dollars
($0.00) for administrative costs associated with a survey of its relevant locality.
During the subsequent terms of this Contract, GSC reserves the right to seek
reimbursement of its actual administrative costs associated with conducting the
survey for the City. The City and GSC shall amend this Contract to set forth the
rate of reimbursement.

IV. PAYMENT FOR SERVICES
V. TERM
This Contract shall be effective on the date last signed below, and will continue
through (one year past date signed). On that date this Contract shall and will
automatically renew for an additional year and each year thereafter until one
party terminates the Contract upon 90 days written notice.

The Receiving Entity shall pay for services from appropriation items or accounts
of the Receiving Entity from which like expenditures would normally be paid from
current revenue available to Receiving Entity, Based upon vouchers drawn by
the Receiving Entity payable to the Performing Agency.
Payments for services performed shall be billed as charges are incurred. The
Receiving Entity agrees to remit payment within thirty (30) days of receipt of an
invoice.
VI. CERTIFICATIONS
The undersigned parties do hereby certify that:
1. The services specified above are necessary and essential for activities that
are properly within the statutory functions and programs of the effected
entities of state and local government.
2. The proposed arrangements serve the interest of efficient and economical
administration of the State government, and the services, supplies, or
materials contracted for are not required by Section 21 of Article 16 of the
Constitution of Texas to be supplied under Contract given to lowest
responsible bidder.
3. The Receiving Entity further certifies that it has the authority to contract for
these services pursuant to Chapter 791, Texas Government Code and
Chapter 2258, Texas Government Code.
4. The GSC further certifies that it has authority to perform the services
contracted for by authority granted in Subtitle D, Title 10, and Chapter 2258,
Texas Government Code.
VII. CUSTOMER SERVICE COMPLAINTS
The undersigned parties bind themselves to the faithful performance of this Contract. It
is mutually understood that this Contract shall not become effective until the date of the
last party to sign and that signatures must be obtained prior to the beginning date of the
Contract.

WHEREAS, the City of Round Rock, Texas engages in public
works projects from time to time; and
WHEREAS, Chapter 2258 of Texas Government Code requires the
public body awarding a contract for public works to specify in the
call for bids for said contract the general prevailing rate of per
diem wages in the locality in which the work is to be performed for
each craft or type or workman or mechanic needed to execute the
contract; and
WHEREAS, to ascertain the general prevailing wage rate, the
public body must either conduct a survey or adopt the prevailing
wage rate as determined by the U.S. Department of Labor in
accordance with the Davis -Bacon Act, if the survey on which the
Davis -Bacon rate was founded was conducted within three years prior
to the bidding of the project; and
WHEREAS, the survey on which the Davis -Bacon rate for
Williamson County and the surrounding area was founded was
conducted more than three years ago; and
WHEREAS, the General Services Commission of the State of
Texas has conducted a survey to determine the prevailing wage rate
for all areas of the State of Texas, including the Williamson
County area; and
WHEREAS, the Interlocal Cooperation Act, Chapter 791 of the
Texas Government Code Annotated, authorizes a local government to
contract with a state agency to perform a function that each party
is authorized to perform individually; and
TEXAS,
WHEREAS, City of Round Rock desires to utilize the prevailing
wage rate survey conducted by the General Services Commission to
satisfy the requirements of Chapter 2258, Texas Government Code;
Now Therefore,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
That the Mayor is hereby authorized and directed to execute on
behalf of the City an Interlocal Cooperation Contract with the
General Services Commission to provide the City with a prevailing
wage determination upon request, a copy of said Contract being
attached hereto as Exhibit "A ", and
BE IT FURTHER RESOLVED,
That the City of Round Rock hereby adopts the Prevailing Wage
Rates as determined by the survey provided by the General Services
Commission, a copy of which is attached hereto as Exhibit "B ".
The City Council hereby finds and declares that written notice
of the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to
the public as required by law at all times during which this
Resolution and the subject matter hereof were discussed, considered
and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended, and the Act.

PREVAILING WAGE RATE DETERMINATION INFORMATION
(To Be Included in Bid Package)
Chapter 2258, Texas Government Code Title 10 requires that state agencies
(including universities), cities, counties, independent school districts, and all other
political subdivisions that engage in public works construction projects produce and
include prevailing-wage rate determinations in the project bid documents and in the
construction contract.

Pursuant to the requirements of this statute, the General Services Commission Wage
Rate Determination Program has ascertained the following wages are to be paid for the
various classifications of workers, in the locality of this project. Workers on this project
shall not be paid an amount Tess than the listed hourly rate for the various
classifications of work required by this project.
The Worker Classification Definition Sheet should help identify classifications for
workers involved in the project. Workers in classifications where rates are not
identified, or in classifications not found on the Worker Classification Definition Sheet
shall be paid a wage not less than the general prevailing wage rate of "laborer".
Building construction wage rates shall be paid to all workers, except those workers
engaged in site work and construction beyond five feet of buildings.
The hourly rate for legal holiday and overtime work shall be of an amount not Tess than
one and one -half (1 1/2) times the base hourly rate.
The rates specified are joumeyman rates. Apprentices may be used on the project and
may be compensated at a rate determined mutually by the worker and employer. This
rate shall be commensurate with the experience and skill of the worker, but at a rate of
not less than 60% of the journeyman's wage, as shown. At no time shall a joumeyman
supervise more than one (1) apprentice. All apprentices shall be enrolled in a certified
program and shall be under the direct supervision of a joumeyman, working as a crew.
Note: The terms joumeyman and apprentice apply to both union and independent
workers, and are not intended to imply that these positions are union workers only.
Welders shall receive the rate prescribed for the craft performing the operation to which
the welding is incidental, as defined on the Worker Classification Definition Sheet.

ITEM: 10. A. Consider a resolution authorizing the Mayor to execute an interlocal
cooperation contract with the General Services Commission regarding
a survey for determining prevailing wage rates and adopting the current
survey of prevailing wage rates.

The purpose of this resolution is to comply with Article 5159 (a) of the Texas Civil Statutes as
amended by the 73rd Legislature. This amendment relates to the payment of certain laborers,
workers, and mechanics under public contracts. The amendment provides a procedure which
cities with a population of more than 10,000 residents must follow when a dispute arises as to
whether the proper prevailing wage has been paid.
Failure of the City to ascertain and specify in the call for the contract the prevailing wage rate in
that locality relieves the contractor or subcontractor from liability under the act.
The General Services Commission has made a current survey of prevailing wage rates
available. The inter -local agreement authorizes the City to use this survey in compliance with the
statutes. There is no cost to the City in this agreement.
