RESOLUTION Na R- 98- 02- 12 -13D
WHEREAS, Lone Star Gas Company has requested an easement in
order to provide for the relocation of gas lines made necessary by
the construction of the new addition to the City Library, and
WHEREAS, the City Council wishes to grant Lone Star Gas
Company's request, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City an easement in order to provide for the
relocation of gas lines made necessary by the construction of the
new addition to the City Library, a copy of which is attached
hereto and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice
of the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to
the public as required by law at all times during which this
Resolution and the subject matter hereof were discussed, considered
and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended, and the Act.

§ KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF WILLIAMSON §
That for and in consideration of Ten and No /100 Dollars
($10.00) and other good and valuable consideration to the
undersigned, (herein styled GRANTOR, whether one or more) paid, the
receipt of which is hereby acknowledged, the said GRANTOR does
hereby GRANT, SELL and CONVEY unto ENSERCH Corporation (c /o Lone
Star Gas Company, 301 South Harwood Street, Dallas, Texas 75201),
a corporation (herein styled GRANTEE), its successors and assigns,
a free and unobstructed right of way and easement twenty feet (20')
in width to construct, inspect, maintain, repair, operate, replace,
relocate, change the size of, all within the easement herein
described, and remove at will, in whole or in part, pipelines and
appurtenances thereto, cathodic protection equipment and aerial
markers over and through the following described land situated in
the State of Texas, County of Williamson, to -wit:
Being Lot 12, Block 21 City of Round Rock, Texas recorded
in Cabinet A, Slide 190 plat records of Williamson
County, Texas
more fully described in Deed from Jo Ann Robinson et vir to The
City of Round Rock, recorded as document number 9708698, Deed
Records of said county, to which reference is made for further
description.
The right of way and easement herein conveyed shall be shown
on the Exhibit "A" attached hereto and made a part hereof. GRANTEE
shall also be entitled to use an additional fifteen feet (15') of
GRANTOR'S adjacent land and additional land as reasonably necessary
at road and creek crossings for construction purposes and this
right is to terminate upon completion of the initial construction.
TO HAVE AND TO HOLD unto said GRANTEE, its successors and
assigns, so long as such lines, appurtenances and facilities
thereto shall be maintained, with ingress to and egress from the
premises across the adjacent lands of GRANTOR, for the purpose of
this grant. GRANTOR shall not interfere with the exercise of
GRANTEE'S rights by constructing or permitting to be constructed
any permanent structure upon the easement strip herein conveyed and
GRANTOR further agrees not to change the grade, remove dirt from
the surface of the easement or impound water over the easement
without prior approval of GRANTEE.
GRANTEE hereby agrees to bury all pipe to a sufficient depth
so as not to interfere with cultivation of soil and to pay any
damages which may arise to the surface from the construction,
maintenance and operations of pipelines and related facilities
constructed under the terms of this grant. The consideration
received for this easement includes payment for the normal damages
caused by the initial construction of the pipeline and its
appurtenances.
The consideration first above recited as being paid to GRANTOR
by GRANTEE is in full satisfaction of every right hereby granted.
All covenants and agreements herein contained shall extend to and

be binding upon the respective heirs, legal representatives,
successors and assigns of the parties hereto and is further
assignable in whole or in part.
It is hereby understood that the party securing this grant in
behalf of GRANTEE is without authority to make any covenant or
agreement not herein expressed.

FROM: Larry Madsen, Construction Manager
Lone Star Gas Co. will be relocating two gas lines in the alley behind the Public
Library to accommodate the new construction on the Library. They will need a 20
foot easement along the west property line of this project to accomplish this work.
I have attached an easement document with a sketch of the easement. I recommend
approval of this item.
