This will make 10,401 acre -feet of water per year available to Round Rock under the 1978 Contract and pursuant to the terms of the Raw Water Line Agreement. Contemporaneously with this Amendment, the City of Georgetown's Lake Georgetown Water Supply Contract is being amended to reduce the water available to it to 3,039 acre -feet of water per year. Also, the Raw Water Line Agreement is being amended to delete the 50 percent surcharge requirement for City of Georgetown water made available for use by Round Rock pursuant to the Raw Water Line Agreement, and to provide for the City of Georgetown to reacquire any of its water that has been made available to Round Rock upon 24 months notice to both Round Rock and the Authority. B. CANCELLATION OF THIRD AMENDMENT The "Third Amendment To Water Supply Contract By And Between Brazos River Authority And City Of Round Rock," dated October 9, 1996, is hereby cancelled in its entirety. 2 C. AMENDMENT TO SECTION 3 OF SECOND AMENDMENT, AVAILABILITY OF WATER TO ROUND ROCK SECTION 3 OF SECOND AMENDMENT, AVAILABILITY OF WATER TO ROUND ROCK, is deleted in its entirety and replaced with the following: SECTION 3, AVAILABILITY OF WATER TO ROUND ROCK. While the 1978 Contract, as amended, remains in force and until such time as the City of Georgetown gives the notice to reacquire its original water pursuant to the Raw Water Line Agreement, as amended, and such notice period lapses, Round Rock shall have the right to divert and use up to 10,401 acre -feet of water per year. This amount shall not be decreased; however, should this amount of water exceed Round Rock's needs, Authority will, upon written request from Round Rock, use reasonable efforts to sell the water for which Round Rock has obligated itself to pay by the 1978 Contract, as amended, in excess of the amounts which it can actually use and will apply the proceeds of any such sale in excess of Authority's costs in making such sale and supplying the water sold against the obligations of Round Rock to make payments to Authority under the 1978 Contract, as amended. If not previously reacquired by the City of Georgetown as provided for in the Raw Water Line Agreement, at the completion of the "Project ", Round Rock shall re- convey to the City of Georgetown the 3,681 acre -feet of water per year made available to Round Rock prior to completion of the "Project ". In accordance with the provisions of the Raw Water Line Agreement, if Round Rock determines that it will have need for more than the 10,401 acre -feet of water per year committed to it under the 1978 Contract, as amended, it may file a written request for an increased commitment at least ninety (90) days prior to the desired date of such increase. Upon such request, the Authority will follow the procedures and apply the pricing structure required under the Raw Water 3 Line Agreement, as amended, if such requested additional water or a portion thereof is available for acquisition by Round Rock. D. AMENDMENT TO SECTION 4 OF SECOND AMENDMENT, DETERMINATION OF PAYMENTS SECTION 4 OF SECOND AMENDMENT, DETERMINATION OF PAYMENTS, is deleted in its entirety and replaced with the following: SECTION 4, DETERMINATION OF PAYMENTS. Round Rock shall make payments to Authority during each year while the 1978 Contract, as amended, remains in force for the original 6,720 acre -feet of water per year committed to it at the Election Use Water price, as escalated pursuant to Second Amendment. Round Rock shall make payments to Authority during each year while the 1978 Contract, as amended, remains in force for the 3,681 acre -feet of water per year acquired from the City of Georgetown through this Fourth Amendment and for any future water acquired from the City of Georgetown pursuant to the Raw Water Line Agreement, as amended, at the Election Use Water price, as escalated, pursuant to the Second Amendment. E. AMENDMENT TO SECTION 7 OF SECOND AMENDMENT, EMERGENCIES SECTION 7 OF SECOND AMENDMENT, EMERGENCIES, is amended by the deletion of the equation "P equals 6,720 (D /C)" and the addition in its place of the equation "P equals 10,401 (D /C)." This amount shall not be decreased except pursuant to the terms and conditions of SECTION 7, SALES OF ELECTION USE WATER, of the Third Amendment. If not previously reacquired by Georgetown as provided for in the Raw Water Line Agreement, at the completion of the "Project ", Georgetown shall reacquire the 3,681 acre -feet of water per year it has allowed the City of Round Rock to use prior to completion of the "Project ". Georgetown currently has 2,388 acre -feet of water per year available to it as Election Use Water. Should Georgetown wish to convert any of its remaining 651 acre -feet of water per year of Option Water to Election Use Water, it shall give at least 30 days advance written notice of the date, which shall coincide with the first day of a month, on which it wishes the conversion to be effective and of the amount of water, in acre -feet per year, to be converted from Option Water to Election Use Water. The amount of water designated as Election Use Water shall not thereafter be decreased, except pursuant to the terms and conditions of SECTION 7, SALES OF ELECTION USE WATER, of the Third Amendment. C. AMENDMENT TO SECTION 4 OF THIRD AMENDMENT, DETERMINATION OF PAYMENTS SECTION 4 OF THIRD AMENDMENT, DETERMINATION OF PAYMENTS, is amended by the deletion of the words "at the rate which is in effect" from the first sentence of that section and by the deletion of the number "6,720" in line five of that section and the addition in its place of the number "3,039." 3 IN WITNESS WHEREOF, this Fourth Amendment is executed on behalf of Authority and Georgetown by their respective officers hereunto duly authorized, in duplicate counterparts, each of which shall constitute an original, but both of which when taken together shall constitute but one and the same Fourth Amendment, as of January 1, 1997, which date shall be deemed to be the date hereof for all purposes. Consider a resolution authorizing the Mayor to execute the Fourth Amendment to Water Supply Contract By and Between Brazos River Authority and the City of Round Rock. The purpose of this Fourth Amendment is to change the amount of water available for use by Round Rock under "Williamson County Regional Raw Water Line Agreement." This will make 10,401 acre feet of water per year available to Round Rock. The City of Georgetown's Lake Georgetown Water Supply Contract is being amended to reduce the water available to it to 3,039 acre feet of water per year. Also, the Raw Water Line Agreement is being amended to delete the 50 percent surcharge requirement for City of Georgetown water made available for use by Round Rock pursuant to the Raw Water Line Agreement, and to provide for the City of Georgetown to reacquire any of its water that has been made available to Round Rock upon 24 months notice to both Round Rock and the Authority.
