R-98-04-23-10D3 - 4/23/1998WHEREAS, during the construction of certain off -site utility improvements required by the development known as the Nelson Nagle Office Building at 400 West Main Street, it was discovered that repairs were urgently needed to existing water and drainage lines, and WHEREAS, the emergency nature of these repairs precluded the taking of bids for said repairs, and WHEREAS, it was agreed that the contractor performing the work for the Nelson Nagle Office Building would perform the emergency repairs at the City's cost, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the City Council hereby approves of the reimbursement to Nelson Nagle of $56,314.17, which is the cost of emergency repairs to the water and drainage lines and the repair of the street in the vicinity of 400 West Main Street. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended, and the Act. Fisher, P.F. Terry E. Hagood, P.S. On behalf of Mr. Nelson Nagle, I would like to submit this request for reimbursement of storm drainage and street improvements for the above referenced project. These improvements have been constructed as a part of the approved construction plans for Mr. Nagle's Office Building Project. In order for Mr. Nagle to participate in the Regional Stormwater Detention Program and not provide on -site detention, it would have been necessary to construct an 18" storm sewer and associated improvements from the site along the same alignment in Main Street as the approved system shown on the construction plans. These improvements would have conveyed only the fully developed on -site and upstream flows which contribute to the site. However, during the design phase Mr. Danny Halden requested the portion of the storm sewer system constructed within the public right -of -way to be increased in size and complexity to accommodate developed stormwater flows from adjacent properties and streets which do not contribute to Mr. Nagle's site. The following represents additional costs to construct the additional offsite drainage improvements. Consider a resolution approving the reimbursement to Nelson Nagle for oversize of the storm drainage system and related street improvements and repair associated with the Nelson Nagle Office Building Development at 400 West Main Street. The total participation is $56,314.17. This cost participation provides for the oversizing of the storm drainage system to accommodate off -site drainage flows and for street improvements and repair in Harris Street and Main Street adjacent to the development and along the route of the storm drain system in West Main Street.
