RESOLUTION NO. R- 98- 06- 25 -10B1
WHEREAS, Section 13.02 of the Home Rule Charter for the City
of Round Rock, Texas, provides that the Council shall designate a
public newspaper of general circulation in the City as official
publication for legal notices, and
WHEREAS, the Round Rock Leader is a public newspaper of
general circulation in the City, and
WHEREAS, the Council is desirous of designating the Round
Rock Leader as the official publication of the City, Now Therefore,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS,
That the Round Rock Leader is designated as the official
publication of the City and all ordinances, notices and any other
matter required to be published shall be published therein, and
BE IT FURTHER RESOLVED that the Council hereby authorizes
the Mayor to execute a one year contract with the Round Rock Leader
to provide the required services at its normal and usual rates, a
copy of said contract being attached hereto and incorporated herein
for all purposes.
The City Council hereby finds and declares that written notice
of the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to
the public as required by law at all times during which this
Resolution and the subject matter hereof were discussed, considered
and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended, and the Act.

Agreement made this L day of
199 between the City of
Round Rock, Texas, a municipal corporation operating under a home rule charter, hereinafter
called "CITY", and TODD PUBLICATIONS - ROUND ROCK, a Texas corporation doing
business at 105 S. Blair, Round Rock, Texas, hereinafter called "TODD ":
WHEREAS, TODD is the publisher of the Round Rock Leader, a public newspaper of
general circulation in the CITY and;
WHEREAS, the Home Rule Charter for the CITY provides that the Council shall
annually designate a public newspaper as official organ of the CITY, and;
WHEREAS, the Home Rule Charter instructs the Council to contract annually with a
public newspaper, and;
WHEREAS, the Council has by resolution designated the Round Rock Leader as the
official organ of CITY;
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
TODD agrees to publish in the Round Rock Leader all ordinances, notices and any other
matter required to be published by the Home Rule Charter, the ordinances of the CTTY, or the
constitution and/or laws of the State of Texas. TODD further agrees that all such matter delivered
to its office by 3:30 p.m. o'clock on Monday will be published in the paper dated and delivered
the Thursday immediately following, and that all such matter delivered to its office by 3:30 p.m.
o'clock on Thursday will be published in the paper dated and delivered the Monday immediately
following.
TODD further agrees to provide CITY with all appropriate affidavits of publication and
clippings of actual publications as may from time to time be requested by CITY.
II.
In consideration for the foregoing, CITY agrees to pay TODD at the same rate which
TODD charges all government subdivisions for the insertions and publication of such matter; that
rate being 23 cents per word for each insertion. The rate for maps /drawings will be charged
at $7.40 per column inch.
The foregoing shall not prevent TODD from periodically changing the rates, but any
such change shall be reasonable and the CITY shall never be charged more than the rate which
TODD charges to the general public.

The obligations and undertakings of each of the parties to their agreement shall be
performable at Round Rock, Williamson County, Texas.
IV.
This Agreement shall be governed by and construed in accordance with the laws of the
State of Texas.

LEADER for 1998 -1999. The rates will be 23 cents per word. However, the rate for

SUBJECT: City Council Agenda, June 25, 1998
ITEM: 10.B.1. Consider a resolution authorizing the Mayor to enter into a
contract for publication of official City notices. By Charter,
the City is required to enter into a yearly agreement with a
publication of general circulation to publish all officially required
notices. Staff recommends the ROUND ROCK LEADER. Staff

As set out in the City Charter, the Council must designate a newspaper of "general
circulation: as the official publication for all required notices. The City currently places all
required notices such as public notices, ordinance captions and notice to bidders in the
ROUND ROCK LEADER. Employment ads and notice to bidders are placed in the
AUSTIN AMERICAN STATESMAN because of wider circulation. This arrangement
works well for all concerned. The staff and the ROUND ROCK LEADER have always
enjoyed a very professional relationship and worked closely to ensure that all required
notices have been published in a timely and proper manner. Staff recommends that the
current arrangement continue and the Council enter into an agreement designating the
ROUND ROCK LEADER as the official publication for required public notices.
