R- 98- 09- 10 -10D1 WHEREAS, V.T.C.A., Government Code, Chapter 791, the Texas interlocal Cooperation Act, provides that any one or more public agencies may contract with each governmental functions and services WHEREAS, the City of Round Interlocal Agreement ( "Agreement ") a part of the Texas A&M University S area for equipment and personnel that are providing mutual aid in response to wildland fires, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City said Agreement, a copy of same being attached hereto and incorporated herein for all purposes. G I - 1 CHARLES CULPEPTER, Mayor City of Round Rock, Texas Contract No. CO -8 -008 Texas Forest service A Part of The Texas A&M University System Interlocal Agreement WHEREAS, the Texas Forest Service, Round Rock Staging Area, hereinafter termed the Service, in cooperation with Round Rock Fire Department, hereinafter termed the Contractor, agree to provide the functional position of a Staging Area Manager under the responsibility of the Austin -Waco Branch Incident Command. The Service is the entity who will act as administrator for the program and will be responsible for the execution of the agreement; Whereas on June 4, 1998, Governor Bush proclaimed the existence of a Disaster in Texas due to extreme fire hazard, authorizing the Service to take all necessary measures to meet this disaster. Under this authorization the following is agreed to: I. Project Description and Services to be Performed by Contractor The Contractor agrees to furnish it's facilities to Service as a staging area and to provide the services of a Staging Area Manager at Round Rock during the 1998 Fire Season until demobilized by the Austin -Waco Branch Incident Commander. The Manager will be responsible for managing all activities within the Staging Area to include the following: a. Obtain a briefing from the Operations Section Chief for the Austin -Waco Branch. b. Establish the staging area layout. c. Determine and order support as needed. d. Establish check -in function as needed. e. Post traffic plan for the staging area and surrounding area. f. Respond to requests for resource assignment. g. Report resource status changes as required. h. Maintain staging area in orderly condition. i. Maintain a Unit -Log (ICS Form 214). j. Lookout for the interest of the Texas Forest Service and the City of Round Rock. II. Responsibilities of the Service include: a. Execution of this Agreement and any documentation associated with the Agreement. b. To compensate and reimburse the Contractor for regular wages, overtime and additional expenses incurred through the activities under this Agreement, including but not limited to telephone services, extra garbage service, photocopies, fax services, etc. to be billed by Contractor to Service. 2,\TEXT \$rS \COS000.wr0/kls Contract No. CO -8-008 Page 2 c. The Service shall schedule with the Contractor for the use of their personnel and services. III. Term of Agreement: This agreement shall commence on July 1, 1998 and terminate on January 31, 1999. This Agreement may be extended by mutual written agreement of both parties, for an additional five months in whatever increments deem logical. But the original term and its extensions shall not exceed a total of one year. IV. Amendment and Termination This agreement may be altered or amended only by mutual written consent and may be terminated by the Service at any time by written notice to the Contractor. Likewise, the Contractor may notify the service of a need to terminate the Agreement. Upon such notice, the Contractor shall submit a final statement to the Service for final payment. V. No Debt Against the State This agreement shall not be construed as creating any debt by or on behalf of the State of Texas and the Texas Forest Service, and all obligations of the State of Texas are subject to the availability of funds. VI. Indemnification The Contractor agrees to hold the Service harmless from any and all claims for personal injuries, property damages, or other claims and damages of any nature that may arise while carrying out the provision of this agreement. The Contractor is not subject to Worker's Compensation Cove age under the Texas Forest Service ant The Texas A &M University System programs. Consider a resolution authorizing the Mayor to execute an interlocal agreement with the Texas Forest Services The City of Round Rock is serving as a Staging area for the Texas Forest Service, West, Texas Division since June of 1998. The agreement will allow for some reimbursement for materials and labor associated with the presence of U.S. and Texas Forest Service personnel. Governor Bush declared an emergency in the State of Texas due to the potential Wildfires in the State from the drought. This deployment was greatly appreciated throughout the State as the crews have assisted local communities in containing and extinguishing thousands of acres burned.
