WHEREAS, V.T.C.A., Government Code, Chapter 791, the Texas
Interlocal Cooperation Act, provides that any one or more public
agencies may contract with each other for the performance of
governmental functions and services under the terms of the Act, and
WHEREAS, the City of Round Rock wishes to enter into an
Interlocal Agreement ( "Agreement ") with Williamson County for
improvements to County Road 122 from U.S. 79 to Forest Creek Drive,
Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City said Agreement, a copy of same being attached
hereto and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice
of the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to
the public as required by law at all times during which this
Resolution and the subject matter hereof were discussed, considered
and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended, and the Act.

Interiocat Agreement
L The following agreement has been entered into between Williamson
County, Texas, ("County"), and the City of Round Rock, Texas ("City"), pursuant to
the Texas Interiocal Cooperation Act, Texas Government Code, Chapter 791.
2. In consideration of the undertakings by City under this agreement, County
agrees to pay City the sum of Four Hundred Thousand Dollars ($400,000.00) within
30 days of the signing of this agreement. This payment will be from current
revenues available to County, and City agrees that it constitutes fair compensation.
County further hereby cedes to City all its right, title, and interest to that portion of
County Road 122 located south from U.S. Highway 79 to the existing City limits,
subject to reverter if City fails to meet its obligations under this agreement.
3. In consideration of these undertakings by County, City agrees to accept
control, responsibility, and liability immediately as of the date of payment for that
portion of County Road 122 located south from U.S. Highway 79 to the existing City
limits. City further agrees to annex this portion of the road into its corporate limits
and let contracts for the improvement of the road to the standards for City arterial
streets within one year from the date of payment. Time is of the essence.
4. If either party fails to meet its obligations under this agreement, the other
party may seek liquidated damages in an amount equal to $400,000 plus 10% annual
interest from the date this agreement is signed, together with all costs of collection.

As you know, the County has set aside $400,000 of bond money for improvements to CR 122
South of Highway 79. I believe it is the consensus of the Commissioners Court to make these
funds available to the City of Round Rock at this time.
Naturally, this transfer of funds will have to be made by Commissioners Court. As soon as the
City is ready to take control of this money and agree to annex CR 122 South of Highway 79 I
believe the Court will be agreeable.
Please let me know if there is any information on this matter that you can provide as to what the
City's plans are for this area in the near future.
If there is anything I can do to aid in this transfer please let me know.

Opinion of Probable Cost
Dear Jim,
Attached, please find a preliminary Engineer's Opinion of Probable Cost for improvements
to County Road 122 from Highway 79 to the City Limit line just north of Forest Creek
Drive. Included in these calculations was the realignment of County Road 122, north of
Highway 79, eliminating the offset now occurring at Highway 79.
The estimate was prepared with the following assumptions:
1. The cross section of the improved C.R. 122 will be identical to the previous
improvements. (Widen roadway to 26 feet with asphalt stabilized base & overlay
with 21/4" avg. thickness H.M.A.C.)
2. Add center left turn lanes at County Road 123, Forest Ridge/Evergreen Drive and
Woodland Loop.
3. The design speed for the reverse curve north of Highway 79 is 45 mph.
4. For the purpose of this estimate, we have used the prices quoted by Hunter Industries
for the previous improvements plus 10 %.
Based upon the above assumptions, we would estimate the total construction cost of the
County Road 122 Phase II improvements to be approximately: $428,716.00.
