The assessment was conducted in accordance with our proposal /contract dated November 5, 1998. The purpose of the assessment was to determine the likelihood of past generation, storage, disposal, or use of hazardous materials or substances on the subject property, and to establish the need for further investigation of any potential health hazards. Surveys for radon, wetlands, endangered species, archaeological finds, existing structures, groundwater recharge features, or noise pollution were specifically excluded from this assessment. Hazardous materials are defined as any material or substance which in normal use can be damaging to the health and well -being of humans. The general categories of hazardous materials and substances are: (1) toxic agents such as poisons, (2) corrosive chemicals such as sulfuric acid, (3) flammable materials such as gasoline, (4) explosives, (5) materials in which dangerous heat build -up may occur during storage, and (6) radioactive substancest 1.2 SCOPE This Phase I Environmental Site Assessment was based on a site inspection, aerial photographs, interviews with people familiar with the site, a chain of title summary, and a review of records available from Federal and State regulatory agencies. The site inspection, interviews, and records review was performed by the authors of this report. The Federal and State regulatory agency records were researched by Environmental Data Resources, Inc., and the 50 year title search was performed by Land Records of Texas. The site inspection involved visiting the site to observe the condition of vegetation and exposed soils and to locate structures, underground storage tanks, and other features that are indicative of potential environmental contamination. Environmental samples of surface and subsurface materials 2 were not acquired or tested In the completion of this Phase I investigation. Thus, all observations of the site were strictly visual. The records review involved a search of documents to determine the known locations of solid waste disposal sites, underground storage tanks, and hazardous waste generation, disposal, storage, and treatment sites on and near the subject property. Records of the U.S. Environmental Protection Agency (EPA) and Texas Natural Resources Conservation Commission (TNRCC) were reviewed. In addition, aerial photographs covering the subject site and surrounding property were obtained for the years 1966, 1970, 1984, and 1994. Information obtained from the site inspection and records review was evaluated to determine the need for additional surveys or investigations to locate, characterize, or quantify suspected or known hazardous materials or substances that could adversely affect the subject property. 1.3 DESCRIPTION AND LOCATION The subject property is located east of Round Rock in Williamson County, Texas (see Plate I in the Appendix). The property covered by this Phase I Environmental Site Assessment consists of approximately 88 acres on the north side of SH 79 east of the entrance to Old Settlers Park. 2.0 SITE ASSESSMENT 3 2.1 GEOLOGIC SETTING The subject property is in the Rolling Prairie physiographic region of Central Texas. That area is characterized by topography consisting of moderately dissected terrain having low relief and flat slopes. The geologic map of the region indicates that the primary geologic units in the area are the Austin Chalk Formation overlain by Fluviatile Terrace Deposits. The Austin Chalk is comprised of chalky limestone, limestone, and marl (a hard calcareous clay). The Austin Chalk is gray to light gray in color. Weathering produces a tan to white color. More severe weathering near the surface creates a soil profile varying from dark fat clays, to light lean clays, to a soil /rock mixture referred to as severely weathered limestone. Overlying the Austin Chalk are more recent terrace deposits consisting of sand, gravel, silt, and clay deposited by Brushy Creek and its tributaries. 2.2 TOPOGRAPHY The subject property is located on a broad gentle slope with the Chandler Branch of Brushy Creek on the north side of the property. Slopes on the majority of the site are generally less than 3 percent, however there is a steep slope adjacent to the creek. A reproduction of the U.S.G.S. topographic map of the site area is included on Plate I. 2.3 HYDROGEOLOGY The Austin Formation is a very minor producer of groundwater in Travis County. Groundwater in the Austin Formation occurs primarily in the upper, weathered portions where joints and cracks provide a means of water entry and transmission. At this site, the water will generally seep down though the overlying terrace deposits and accumulate on top of the first limestone layer. Typically, this water will either evaporate or flow down gradient. 2.4 VEGETATION The majority of the site consists of a corn field. An open hay field is located on the north side of the property between the corn field and the Chandler Branch of Brushy Creek. The property immediately adjacent to the creek is wooded. ATrinity Ei _ Corporation • The Chandler Branch of Brushy Creek is adjacent to the north side of the property, and the land adjacent to the creek is sloped steeply near the edge of the creek. 4 2.5 ADJACENT LAND The land on the west and north side of the property is occupied by Old Settlers Park. SH 79 is on the south side of the property and farm land is located on the land beyond the highway. The land to the east is used as pasture for cattle. West of the property, within the park, is a tract owned by The Old Settlers Association. A portion of this tract is used as a motor home park. 2.6 SITE HISTORY The property is described as 88.411 acres in the P. A. Holder Survey, Abstract 297. The current owner of the property is Arnold Telander. The succession of owners of that property is listed in the Appendix. A telephone interview was conducted with Mr. Telander. Mr. Telander indicated that to his knowledge the property has had no use other than farming. The farm does have a diesel tank and a pesticide tank but there have not been any spills from these tanks. Pesticides have been used on crops on the property. A telephone interview was conducted with Mr. Jim Nuse, Public Works Director for the City of Round Rock. He indicated that he is not aware of any environmental issues in regards to either the subject property or the adjacent Old Settlers Park. A telephone interview was also conducted with Mr. Randy Gordon of the Round Rock Parks Department. Mr. Gordon said that he was not aware of any environmental concerns related to Old Settlers Park. Mr. Gordon has been involved with the park since it was purchased by Round Rock. Their comments were used to help establish the history of the site. In addition, aerial photographs taken in 1973, 1984 and 1994 were also reviewed as well as the U.S.G.S. topographic map covering the subject property. Careful interpretation of the above resources revealed that the site does not appear to have had any other use than as farmland. There is no evidence of any excavations or other non -farm related activities on this subject property or adjacent properties except for the development of Old Settlers Park. 2.7 SITE INSPECTION An inspection was performed on the site and surrounding property to view and document locations of the following: (1) areas of dead or distressed vegetation, (2) drums, barrels, or other containers stored on the property, (3) discolored or polluted water, (4) unusual or noxious odors, and (5) solid waste disposal areas. Site inspections, which were made on November 20 and 22, 1998, revealed the following items: Aiertinfty g Tasting Corporation 5 • Various amounts of scrap metal, wood, and other debris are scattered in the northeast and north central portion of the property. This debris appears to be the remains of a windmill, some farm equipment and a building. • There are scattered areas where excavation has recently occurred. Mr. Jim Nuse with the City of Round Rock indicated that these excavations were from the archeological survey conducted on the site. • In the vicinity of the existing buildings there are a 1000 gallon diesel tank, a 500 gallon propane tank and a 200 gallon fiberglass tank that is used to store pesticide. All of these tanks are above ground. There was no visual indication that these tanks have had leaks or spills associated with them. In addition, there are two 30 gallon drums or hydraulic fluid, several cans of paint, a small container of pesticide, and a can of paint thinner. All of these were sealed and there was no visual evidence that any of them had leaked. 2.8 REGULATORY AGENCY REVIEW Records of the EPA and TNRCC were reviewed to evaluate the presence of or potential for contamination of the subject property by hazardous materials and substances. The following list summarizes the findings of that research. Federal SUPERFUND (NPL) Sites - None are reported within 1.25 miles of this site. State SUPERFUND Sites - None are reported within 1.25 miles of this site. Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA) Sites - None are reported within 0.75 miles of this site. Resource Conservation and Recovery Act of 1976 (RCRA) Sites — None are reported within 0.5 miles of this site. Petroleum Storage Tanks (PST) (TNRCC) - None are reported within 0.5 miles of this site. Leaking Petroleum Storage Tanks (LPST) (TNRCC) - None are reported within 0.75 miles of this site. State Solid Waste Landfills - None are reported within 0.75 miles of this site. Two orphan (unmapped) sites are listed, a LUST a 209 Taylor Highway and a tract of land at FM 3406 and Geenhill Drive listed in the TX VCP database. These site are over three miles from the subject property and should not have any impact on this property. The review of regulatory agency records revealed that there is no evidence to suggest that hazardous or toxic materials or substances have ever been treated, stored, manufactured, or disposed of on the subject property. 'T`rintt r Testing Enginaernig , 3.0 CONCLUSIONS AND RECOMMENDATIONS 3.1 SITE ASSESSMENT The site assessment was based on information obtained from inspection of the property, interpretation of historical aerial photographs and maps, interviews with people familiar with the property, the chain of title summary, and a review of regulatory agency records. Known site conditions at specific points in time have allowed for assembling the general history of the site and surrounding area from the 1950's to the present. It has been assumed that the locations of all solid waste disposal sites and hazardous waste sites at or near the subject properties are known or are available through EPA or TNRCC records or that such sites would be detectable by a site inspection. Environmental drilling and sampling of subsurface materials for detection of contamination were not a part of this Phase I investigation. The following items were revealed by this site assessment. • The subject property appears to have been solely used as farmland. • All of the surrounding property appears to have been used as farmland or pasture except for the development of Old Settlers Park. • A diesel tank, propane tank, pesticide tank and several smaller containers of hydraulic fluid, pesticide and paint were located on the property. There was no visual evidence or historical evidence or recollections that indicate that any of these have leaked. CONSULTANT will endeavor to minimize damage to the land but makes no guarantee to restore the site to its original condition unless a separate agreement is made for such restoration, in which case CONSULTANT shall add the cost of restoration to the fee for THE PROJECT. 2.3 Designate in writing those persons, organizations, or agencies to be contacted in the event conditions are revealed during the execution of CONSULTANTS study that would require possible alteration of the study or would potentially influence design that is proceeding in parallel with the study. ARTICLE 3. GENERAL CONDRIONS: 3.1 CONSULTANT, by the performance of services covered hereunder, does not in any way assume, abridge, or abrogate any of those duties, responsibilities, or authorities with regard to THE PROJECT customarily vested in THE PROJECT architects, design engineers, or any other design agencies or authorities. 3.2 CONSULTANT shall not be responsible for acts or omissions of any other party or parties involved in the design of THE PROJECT or the failure of any contractor or subcontractor to construct any item on THE PROJECT in accordance with recommendations issued by CONSULTANT. 3.3 This Agreement may be terminated by either party upon service of written notice on the other party or by mutual agreement If this Agreement is terminated by either party, CONSULTANT shall be paid in full for all services performed through the termination date, and the CLIENT shall be provided with a complete report of the results of tests and analysis conducted prior to termination. 3.4 Neither CLIENT nor CONSULTANT may delegate, assign, sublet, or transfer his duties or interest in this Agreement without the written consent of the other party. 3.5 The only warranty made by CONSULTANT in connection with its services performed hereunder is that it will use that degree of care and skill as set forth in Article 1.1. No other warranty, expressed or implied, is made or intended for services provided hereunder or furnishing oral or written reports of findings made. 3.6 This Agreement is binding upon and shall inure to the benefit of the parties hereto, their officers, employees, agents, affiliates, subcontractors, heirs, assigns, and personal representatives. ARTICLE 4. UNANTICIPATED HAZARDOUS MATERIALS: 4.1 The CLIENT understands that hazardous materials on or beneath the surface of a site creates extraordinary risks for CONSULTANT including the need for precautions to protect the health and safety of his personnel and to comply with applicable laws and regulations. 4.2 CLIENT agrees that the discovery of unanticipated hazardous materials constitutes a changed condition mandating a renegotiation of the scope of work or termination of services. Since CONSULTANT Is In no way responsible for the presence of these hazardous materials, CLIENT agrees to waive any claim against CONSULTANT and agrees to defend, indemnify, and hold harmless CONSULTANT from any dein or liability for injury, loss, or damages arising from the discovery of unanticipated hazardous materials. ARTICLE 5. INSURANCE/RISK ALLOCATION: 5.1 CONSULTANT shall secure and maintain throughout the full period of this Agreement sufficient insurance to protect it adequately from claims under applicable Workers' Compensation Acts and from claims against the CONSULTANT for bodily injury, death, or property damage as may arise from the performance of services under this Agreement. CONSULTANT will, upon request, file certification of such insurance coverage with CLIENT or his authorized representative. 5.2 In acknowledgement of the multitude of risks inherent in conducting geotechnical and related investigations, and in order to accommodate CLIENTS need for geotechnical services at an economical cost to CLIENT, CLIENT and CONSULTANT agree that CONSULTANTS liability, including attorney fees, to CLIENT for claims arising out of CONSULTANTS negligent professional acts, errors, or omissions in the performance of services described in this Agreement will be limited to 550,000 or CONSULTANTS fee whichever is greater. If the CLIENT prefers to have higher limits of liability, CONSULTANT agrees to increase limits up to a maximum of $500,000 upon CLIENTS written request provided CLIENT agrees to pay additional consideration of 4 percent of the CONSULTANT'S total fee. CONFIDENTIALITY 6.1 All reports and/or information derived as part of CONSULTANTS study shall remain the property of the CONSULTANT. 6.2 The CONSULTANT agrees to consider all reports to be confidential, and will distribute reports only to those persons, organizations, or agencies so directed by the CLIENT with the following exception as described in Article 6.3. 6.3 Reports and/or Information derived as part of CONSULTANTS study may be released to Federal, State, County, or Local authorities where a public safety hazard exists or where applicable statutes and regulations require the CONSULTANT to release information; where the CONSULTANT must comply with judicial court orders; and where CONSULTANT must protect itself from civil claims. In such cases, the CLIENT will be notified in writing of the release of information. 8.4 The CONSULTANTS report, findings, and recommendations are for the CLIENT'S sole use and shall not be transferred or sold to others without the knowledge and consent of the CONSULTANT. ARTICLE 7. PAYMENT 7.1 CLIENT will pay CONSULTANT for services and expenses in accordance with the attached fee schedule. CONSULTANTS invoices will be presented at the completion of its work or monthly and are due on receipt. Failure to pay CONSULTANTS invoice within 30 days shall result in the addition of late payment charges calculated at a rate of 1.5 percent per month on the unpaid balance. 7.2 CONSULTANT shall be paid in full for all services under the Agreement, including any overruns of CLIENT'S contract or any unforeseen need for CONSULTANTS services exceeding original contract requirements. The CONSULTANT agrees not to conduct additional work without first discussing its need and reaching an agreement with the CLIENT as to the additional costs to be incurred. ARTICLE 8. EXTENT OF AGREEMENT: The Agreement, including these terms and conditions, represents the entire Agreement between CLIENT and CONSULTANT and supersedes all prior negotiations, representations, or agreements, written or oral. This investigation will be directed to the eastern end of the site. Plans are not currently available for specific structures that may be constructed at this end of the property. This investigation will therefore be a preliminary investigation similar to that conducted for the west end and reported on July 16, 1998. Piezometers were placed on the previous investigation but will not be used for this investigation. At your request a total of 5 borings will be drilled to investigate the subsurface conditions. The engineering analysis conducted for this investigation will be similar to that performed for the previous investigation. If possible, a simpler report, referencing the July report will be used to reduce time and costs on the project. As in the previous investigation, this investigation will provide a preliminary assessment of the geologic conditions at the site The services described above will be performed at the unit prices shown on the attached FEE SCHEDULE, with a total estimated maximum cost of $8 000.00 This cost will not be exceeded without prior approval from the CLIENT. TETCO will perform only those services outlined above; however, CLIENT and TETCO may subsequently agree in writing to provide additional services rendered under this AGREEMENT for additional, negotiated compensation as per attached fee schedule.
