R-98-12-22-10A1 - 12/22/1998mistakenly charged a regional detention fee for the development of
5.05 acres when in fact only 1.22 acres were developed, and
WHEREAS, they paid a fee of $12,120.00 when the fee should
have been only $2,928.00, and
WHEREAS, they are entitled to a refund of $9,192.00 for the
overpayment of the fee, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS,
That the reimbursement of $9,192.00 is hereby authorized to
the owners of the Cerkial Subdivision for an overpayment of the
regional detention fee.
The City Council hereby finds and declares that written notice
of the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to
the public as required by law at all times during which this
Resolution and the subject matter hereof were discussed, considered
and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended, and the Act.

Dear Ms. Cirkeil:
This letter is written in regard to the public works improvements constructed
in conjunction with the above referenced subdivision.
These improvements have been completed in accordance with City of Round
Rock specifications and code, as certified by your engineer, and we are in receipt
of your affidavit stating that the work has been completed in compliance with
the applicable provisions of the code, with your request the improvements be
accepted by the City of Round Rock. This letter shall constitute the formal
acceptance of the subdivision water, wastewater, street and drainage
improvements for maintenance by the City of Round Rock.
Accordingly, the warranty period for these improvements will extend as follows:

ITEM: 10.A.1. Consider a resolution authorizing the Mayor to reimburse a portion
of the regional detention fee paid by the Cerkial Subdivision. The
Cerkial's paid $2,400.00 per acre for 5.05 acres totaling $12,120.00.
However, they only developed 1.22 acres. The fee should have been
$2,928.00, therefore they are due a reimbursement of $9,192.00. If
