WHEREAS, Texas Transportation Commission Minute Order 107707
( "Order ") authorizes the Texas Department of Transportation to
undertake and complete highway improvements generally described as
the reconstruction of U.S. Highway 79 to a four -lane divided
highway from County Road 195 to County Road 110, and
WHEREAS, said highway improvements will facilitate traffic
flow and mitigate congestion and will provide a better
transportation facility for local residents and the traveling
public, and
WHEREAS, the City Council wishes to accept and approve the
provisions of the Order, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS ,
That the City Council hereby accepts and approves the
provisions of the Order attached hereto and incorporated herein for
all purposes.
The Motion to approve the Order was made by Councilman Jimmy Joseph
and seconded by Councilwoman Martha Chavez
in favor of the motion were as follows:

The City Council hereby finds and declares that written notice
of the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to
the public as required by law at all times during which this
Resolution and the subject matter hereof were discussed, considered
and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended, and the Act.

WHEREAS, in WILLIAMSON COUNTY, on U.S. HIGHWAY 79, from County Road 195
to County Road 110, a distance of approximately 2.9 miles, a project to reconstruct U.S. Highway 79
to a four -lane divided highway is being proposed; and
WHEREAS, U.S. Highway 79 has bean the site of numerous accidents, and reconstruction
of the roadway will improve operations and safety; and
WHEREAS, reconstruction of U.S. Highway 79 will also improve access to a future minor
league baseball park and multipurpose center to be located within the limits described above; and
WHEREAS, the City of Round Rock (the "city") has offered to participate in the cost of the
project;
NOW, THEREFORE, IT IS ORDERED that the executive director is hereby directed to
tender the following proposal to the city:
Provided the city will:
1. Provide all preliminary engineering, environmental studies, plans, and 10 percent of the
reimbursable utility adjustments as may be required in accordance with policies of the
Texas Department of Transportation (the "department ").
2. Provide one hundred percent of the right of way for a four -lane divided highway,
including any right of way for environmental mitigation, clear of obstructions and free
of cost to the state with acquisition procedures to be in accordance with policies of the
department and with applicable Federal and State laws governing the acquisition policies
for acquiring real property.
3. Provide 20 percent of the total construction cost not including construction
engineering.
4. Provide one hundred percent of the right of way, utility relocation, construction and
construction engineering costs for the relocation of County Road 122.
The department will:
1. Provide 90 percent of the reimbursable utility adjustments for the project.
2. Provide 80 percent of the construction costs to be funded in Priority 1, Fiscal Year 2002,
Category 12, Strategic Priority Program of the 1999 Unified Transportation Program.
3. Provide 100 percent of the construction engineering costs.

IT IS FURTHER ORDERED that the executive director is hereby authorised to enter into
any necessary agreements and to proceed in the most feasible and economical manner with project
development of U.S. Highway 79 at an estimated construction cost of 53,152,000 to be funded in
Priority 1, Category 12, Strategic Priority Program, Fiscal Year 2002 of the 1999 UTP.
IT 1S UNDERSTOOD that any underruns or overruns incurred on the project will be the
shared responsibility of both the city and the department and will be divided proportionately, using
the aforementioned percentages.
This Order shall become operative upon acceptance by the city, and if not accepted within 90
days of the date hereof, the action contained in this order shall not be implemented.

Minute Order 107707 passed by the Texas Transportation Commission on December 17, 1998 for
the improvement by the Texas Department of Transportation of the project described below:

This Minute Order authorizes the reconstruction of U.S. Highway 79 to a four -

before March 16, 1999, or the actions contained therein shall not be
implemented.
The City may use the attached resolution form to accept the minute order. All
blanks must be completed and individual names are required on the resolution,
even when the vote is unanimous. Also, the form must be sealed and certified
