R- 99- 03- 25 -10D6 WHEREAS, the City of Round Rock has previously entered into an agreement for engineering services ( "Agreement ") with Hejl, Lee & Associates, Inc. for the Rubio Subdivision Street & Drainage Improvements, and WHEREAS, Hejl, Lee & Associates, Inc. has submitted Supplemental Agreement Amendment No. 2 to the Agreement to provide for engineering and geological services required for the preparation of a water pollution abatement plan, and WHEREAS, the City Council desires to enter into said Supplemental Amendment Agreement No. 2 to the Agreement with Hejl, Lee & Associates, Inc., Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental Agreement No. 2 to the Agreement with Hejl, Lee & Associates, Inc. to provide for engineering and geological services required for the preparation of a water pollution abatement plan, a copy of said supplemental agreement being attached hereto and incorporated herein for all purposes. Hejl, Jr., P.E„ R.P.L.S., AICP Subject: Rubio Improvement Project HLA Project No. 13571 Supplemental Agreement Amendment Number 2 Date: February 23, 1999 Pursuant to telephone conversation on February 22, 1999, Hejl, Lee & Associates, Incorporated (HLA) and City of Round Rock staff decided that a TNRCC Water Pollution Abatement Plan (WPAP) was necessary for the proposed channel improvement part of the project. City staff requested HLA provide estimate of fees to assist City in preparing and submitting a WPAP application. We estimate that the fees for assisting the City with this project will be approximately $6,000.00. This fee includes the cost of a Geological Assessment for the project. HLA intends to contract with Horizon Environmental to perform the assessment. This fee does not include payment of TNRCC application fees or other tasks not specifically discussed in this memorandum: Should this fee be acceptable to the City, please so indicate by signing below and returning one copy of this document to our office. WPD DATE: March 19, 1999 SUBJECT: City Council Meeting — March 25, 1999 ITEM: 10.D.6. Consider a resolution authorizing the Mayor to execute Supplemental Agreement Amendment No. 2 to the Contract for Engineering Services with Hejl, Lee and Associates, Inc. for the Rubio Street and Drainage Improvement Project. The Texas Natural Resource Conservation Commission has denied a request for an exception to the water pollution abatement plan requirement for this project and has determined an application for abatement plan approval must be made. This amendment will provide for the engineering and geological services required for the preparation and submission of the plan. With this amendment for $6,000.00 the current amount of the contract for engineering services is $93,800. This amendment and the project are funded from the 1996 General Obligation Bond Program.
