R-99-04-22-10D8 - 4/22/1999WHEREAS, the owners of Lot 22, Southern Terrace Revised, a
Subdivision in the City of Round Rock have petitioned the City Council
to partially release a public utility easement over Lot 22, Southern
Terrace Revised, and
WHEREAS, all authorized public utility users of said easements
have concurred in writing with said petition, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City a Partial Release of Easement, a copy of said
document being attached hereto and incorporated herein for all
purposes.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended, and the Act.

Re: Vacation of 2290 square feet out of that certain public utility
easement (PUE) as dedicated in Volume 561, Page 451 of the
Williamson County Deed Records.
Dear Mayor Culpepper and City Council:
The purpose of this request is to vacate a portion of a public utility easement
(PUE) as captioned. This particular PUE was established by separate instrument
and is not reflected in the official subdivision plat records but was discovered in
a recent survey. Earlier, we, the owners, secured a proper building permit to
construct an addition to the house at this address and we inadvertently
encroached into this PUE. This proposed vacation would fully remedy this
irregularity and would greatly facilitate our effort to refinance this house.
Please note that the affected utility service providers have also reviewed this
request and have no objection to the proposed vacation. Thank you for
considering this request.
