The Round Rock City Council approved Resolution No. R- 99- 04- 22 -10E1 at their
regularly scheduled meeting on April 22, 1999. This resolution expresses the
City Council's opposition to House Bill 1099 and urges you to vigorously
oppose the adoption of said bill.

RESOLUTION NO. R- 99- 04- 22 -10E1
WHEREAS, House Bill 1099 would allow a labor organization to
negotiate with and enter into collective bargaining contracts with
a municipality, and
WHEREAS, House Bill 1099 would not be in the best interests
of the City, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS,
That the City Council wishes to express its opposition to
House Bill 1099 and urges representative Krusee to vigorously
oppose the adoption of said bill.
The City Council hereby finds and declares that written notice
of the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to
the public as required by law at all times during which this
Resolution and the subject matter hereof were discussed, considered
and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended, and the Act.

A BILL TO BE ENTITLED
1 AN ACT
2 relating to collective bargaining by employees of local
3 governments.
4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
5 SECTION 1. Section 617.002, Government Code, is amended to
6 read as follows:
7 Sec. 617.002. COLLECTIVE BARGAINING BY STATE [PUBLIC]
8 EMPLOYEES PROHIBITED. (a) An official of the state [ r of a
9 p litical subdivioi n f thc statc] may not enter into a collective
10 bargaining contract with a labor organization regarding wages,
11 hours, or conditions of employment of public employees.
12 (b) A contract entered into in violation of Subsection (a)
• 13 is void.
14 (c) An official of the state [ r of a p litical subdivici n
15 f thc statc] may not recognize a labor organization as the
16 bargaining agent for a group of public employees.
17 SECTION 2. The importance of this legislation and the
18 crowded condition of the calendars in both houses create an
19 emergency and an imperative public necessity that the
20 constitutional rule requiring bills to be read on three several
21 days in each house be suspended, and this rule is hereby suspended,
22 and that this Act take effect and be in force from and after its
23 passage, and it is so enacted.

BACKGROUND AND PURPOSE
Currently, a political subdivision of the state is prohibited from entering
into a collective bargaining contract with a labor organization concerning
wages, hours, or employment conditions of public employees, and from
recognizing a labor organization as the bargaining agent for a group of
public employees. As a result, a local entity must seek an exemption from
the legislature in order to negotiate with a labor organization acting as a
bargaining agent for public employees such as firefighters and police
officers. The purpose of this bill is to grant local entities more control
over their employment and contracting practices with public employees.
H.B. 1099 allows a political subdivision to negotiate with and enter into
collective bargaining contracts with a labor organization. H.B. 1099 also
allows a political subdivision to recognize a labor organization as the 1
bargaining agent for a group of public employees. f /
RULEMAKING AUTHORITY
It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 617.002, Government Code, as follows:
Sec. 617.002. New title: COLLECTIVE BARGAINING BY STATE EMPLOYEES
PROHIBITED. Deletes language prohibiting a political subdivision of the
state from entering into a collective bargaining contract with a labor
organization concerning wages, hours, or employment conditions of public
employees, and from recognizing a labor organization as the bargaining
agent for a group of public employees. beletes "public" from existing
title.
SECTION 2. Emergency clause.
Effective date: upon passage.
