WHEREAS, the City and the Engineer executed a Contract for Engineering Services, hereinafter call the "Contract," on the 22nd day of December, 1998 concerning the reconstruction of US 79 from County Road 195 to McNutt Creek East of County Road 110, and WHEREAS, ARTICLE 2, SCOPE OF SERVICES TO BE PROVIDED BY ENGINEER, describes those engineering services to be provided by the Engineer as a part of the Contract, and WHEREAS, ARTICLE 4, COMPENSATION, establishes the maximum lump sum payable under this contract at $423,815.00 without modification of the contract, and WHEREAS, it has become necessary to amend the contract to provide for a change in scope of services to include the preparation of plans, specifications, and estimates for the widening of Harrell Parkway from US 79 north approximately 1800 feet, a third traffic signal, roadway illumination at four locations, and to add other miscellaneous engineering and surveying items identified by the Texas Department of Transportation; and to compensate the Engineer for this increased work through the payment of an additional $81,100.00, and WHEREAS, the Engineer has agreed to perform the additional work for $81,100.00 increasing the lump sum fee for the contract to $504,915.00. NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: ARTICLE 4, COMPENSATION shall be amended by changing the lump sum amount payable under this contract to $504,915.00. The Engineer shall design and include in the plans an additional traffic signal for a total of three in the contract; and roadway illumination for four locations along US 79. The Engineer shall conduct a total of five days of traffic counts for the intersections of US 79 with CR 122 and Harrell Parkway. The Engineer shall provide additional surveying services for the ditch from CR 122 to CR 110, 1000' of additional surveying on the east end of the project, and additional surveying services for the Public Utility Easement. R- 99- 05- 13 -13B9 WHEREAS, the City of Round Rock has previously entered into a contract for engineering services ( "Contract ") with Carter & Burgess, Inc. for the preparation of schematics, environmental documents, right of way documents, plans, specifications, estimates, and contract documents for the reconstruction of US 79 as a four -lane divided highway from CR 195 to CR 110, and WHEREAS, Carter & Burgess, Inc. has submitted Supplemental Agreement No. 1 to the Contract to provide for additional work required by the Texas Department of Transportation, and WHEREAS, the City Council desires to enter into said Supplemental Agreement No. 1 to the Contract with Carter & Burgess, Inc., Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental Agreement No. 1 to the Contract with Carter & Burgess, Inc. to provide for additional work required by the Texas Department of Transporation, a copy of said supplemental agreement being attached hereto and incorporated herein for all purposes.
