R- 99- 06- 24 -10A1 WHEREAS, Section 13.02 of the Home Rule Charter for the City of Round Rock, Texas, provides that the Council shall designate a public newspaper of general circulation in the City as official publication for legal notices, and WHEREAS, the Austin American- Statesman is a public newspaper of general circulation in the City, and WHEREAS, the Council is desirous of designating the Austin American- Statesman as the official publication of the City, Now Therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Austin American- Statesman is designated as the official publication of the City and all ordinances, notices and any other matter required to be published shall be published therein, and BE IT FURTHER RESOLVED that the Council hereby authorizes the Mayor to execute a one year contract with the Austin American - Statesman to provide the required services at its normal and usual rates, a copy of said contract being attached hereto and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this R:\ WPDOCS \RESOI.UTI \R90624A1.WPD /s,g Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended, and the Act. RESOLVED ATTEST: r d E LAND, City Secretary this 24th day of June, 1999. 2 City of Round Rock, Texas STATE OF TEXAS CITY OF ROUND ROCK WHEREAS, THE AUSTIN AMERICAN- STATESMAN, is the publisher of a newspaper of general circulation in the CITY and; WHEREAS, the Home Rule Charter for the CITY provides that the Council shall annually designate a newspaper as official organ of the CITY, and; WHEREAS, the Home Rule Charter instructs the Council to contract annually with a general circulation newspaper, and; WHEREAS, the Council has by resolution designated the Austin American- Statesman as the official organ of CITY; NOW, THEREFORE, IT IS AGREED AS FOLLOWS: Austin American- Statesman agrees to publish in the Austin American - Statesman all ordinances, notices and any other matter required to be published by the Home Rule Charter, the ordinances of the CITY, or the constitution and/or laws of the State of Texas. Austin American- Statesman further agrees that such entire matter delivered to its office in accordance with deadline as stated in the Company's rate card will be published on the appropriate day. Austin American- Statesman further agrees to provide CITY with all appropriate affidavits of publication and CITY may from time to time request clippings of actual publications. II. In consideration for the foregoing, CITY agrees to pay Austin American- Statesman at the same rate which Austin American- Statesman charges all government subdivisions for which they qualify for the insertions and publication of such matter; that rate being given as follows in exchange for the CITY agreeing to purchase a minimum of 800 column inches within the Williamson County Zone. The foregoing shall not prevent Austin American- Statesman from periodically changing the rate, but any such change shall be reasonable and the CITY shall never be charged more than the rate which Austin American- Statesman charges to the general public. This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, and the terms and conditions of the current retail and classified advertising rate cards and contracts of the Austin American- Statesman. IV.
