I am pleased to transmit to you the City of Round Rock's Action Plan approval on your Community Development Block Grant Program for Fiscal Year 1999. The amount of your Block Grant is $413,000 and your Action Plan program year will begin on October 1, 1999 and proceed through September 30, 2000. We have taken note of the proposed activities the City will be implementing in the coming year and based on what you have submitted, we have determined that Activity 1 -2: Cops Into Homeowners is ineligible. As described in your Action Plan, CDBG funds in the amount of $60,000 will be used as grants to police officers to buy homes in low and moderate income neighborhoods. In addition, the grant can be applied to renovation and property improvements to existing residence and lot. You have cited the regulations at 24CFR570.202, Eligible rehabilitation and preservation activities and 24CFR570.208(a)(1) to support the area benefit claim. Unfortunately, this claim is incorrect. Section 105(c)(3) of the authorizing statute, the Housing and Community Development Act of 1974, requires that, in order for an activity that involves the acquisition or improvement of property for housing to qualify as benefiting low and moderate income persons, the housing must be occupied by such persons. Even though a particular housing activity may provide a clear benefit to an area containing predominantly low and moderate income residents, it cannot qualify on that basis. Instead, the housinu must be occupied by low and moderate income households. As a result of our determination, the City should prepare for an additional public hearing to discuss and plan for alternative uses of the D. S. For Activity 1 -1, Neighborhood Self -Help Initiative Program (SHIP) Grants, we are suggesting that the City not enter into any contracts until such time that our office receives additional specific information concerning the exact work that will be performed under this category. Based on the information submitted, we are unable to make a final eligibility determination and conclusion on what national objective will be met. Hence, we will need identification of what specific activities will take place, where will the activity take place and who are the ultimate beneficiaries of the investment of CDBG dollars. Please provide this information to our office by October 25, 1999. In comparing the community's Consolidated Plan and the one -year Action Plan, the activities planned for the ensuing twelve month period are consistent with the City's overall five year Vision statement. However, in reviewing your Infrastructure Needs table, we have taken note of the streets, water and sewer improvements that are categorized as Medium priorities and anticipate that the City will address these needs as soon as feasible. As discussed with you and the City's Citizens Advisory Committee, we strongly encourage the City to look for opportunities to leverage its CDBG resources with other stakeholders in the community. For example, the creation of partnerships with nonprofit and for - profit organizations, local financial institutions, local businesses, the local housing authority are, but a few examples of possible resources for leveraging your CDBG funds from within the community. We want to reinforce the importance of maintaining a viable record keeping system of your programs, which at the minimum, should contain information on program eligibility, data on meeting one of the three national objectives, financial management records containing a running balance of expenditures, supported with pertinent invoices, file data of your procurement transactions, wage rate determinations, environmental records, information on public meetings held concerning your CDBG program and mapping information highlighting specific locations of your CDBG activities. Having this type of information will serve as a basis to substantiate that you are tracking performance of on -going activities and monitoring of any subrecipients for compliance with the rules and regulations. The key to having a workable program performance and compliance system is to make use of the IDIS system and continuous self evaluation of your program performance in terms of the local goals and objectives identified in your Consolidated Plan. The end result will allow you to keep local citizens informed about milestones achieved, to better conduct self evaluations of meeting technical requirements of the Block Grant program and for end -of -the year reporting purposes. The grants management system in your community can take any shape and form that best works for you. As a result, we are encouraging you and your staff to conduct a quality control check of your present system and if necessary, implement any changes that you feel are needed to improve upon your current local monitoring system. CPU f Sill AIR m IO,UFXAS 2 As a reminder, your upcoming Consolidated Annual Performance Report (CAPER) is due on December 31, 1999. The purpose of this report is to show what you have accomplished with CDBG funds and other leveraged funds during the previous Program Year and allow the Department, local officials, and the public to arrive at conclusions concerning the grantee's overall performance. To that end, your staff should be inputting data into the IDIS system on a quarterly basis in order for the IDIS- generated reports to produce a complete CAPER and annual performance record. • We want to remind you that certain activities are subject to the Environmental Review Procedures for the CDBG program, otherwise known as 24 CFR Part 58. Funds for such activities may not be obligated or expended unless there is a written Authority to Use Grant funds (HUD Form 7015.16) from our office. Enclosed is the Funding Approval and Grant Agreement for which constitutes the contract between the Department of Housing and Urban Development and the City of Round Rock. Please execute and return two copies of each grant agreement to our office. Failure to return the executed grant agreements within 60 days may be deemed to constitute rejection of the grant and cause for HUD to determine that funds are available for reallocation to other grantees. Should there be a need to establish or change the depository account where the grant funds are being wired to, a Direct Deposit Sign -Up Form (SF- 1199A) must be completed by both the City and the involved financial institution and mailed to our office. In addition, your CDBG funds must be drawn on a first -in -first -out basis. This means that before requesting CDBG funds from a newly established line -of- credit, the City should have first drawn down all of the funds from the previous years' line -of- credit. The special condition in your Grant Agreement and Funding Approval concerning the review procedures under Executive Order 12372, restricts the obligation or expenditure of funds for the planning or construction of water or sewer facilities, until the completion of the review process and receipt of written notification of release of funds from our office.
