R- 99- 10- 28 -10E7 WHEREAS, in order to increase electrical services for the new pump station planned for the Lake Georgetown raw water intake structure, the City of Round Rock wishes to relocate electric lines and facilities at this location, and, WHEREAS, the City desires to enter into a Relocate Facilities Contract with Pedernales Electric Cooperative, Inc., Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City a Relocate Facilities Contract with Pedernales Electric Cooperative, Inc., to relocate electric lines and facilities at the Lake Georgetown raw water intake structure, a copy of said contract being attached hereto and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended, and the Act. I understand these facilities will be relocated at the option of the Cooperative according to the following policy: "Service to other consumers, both present and prospective, will not be adversely affected. Easements on the Cooperative's standard form covering rights -of -way for the relocated lines or facilities are granted to the Cooperative. The consumer pays in advance to the Cooperative the total estimated cost of removing the existing lines and facilities and replacing them with lines and facilities in the new location. The cost will be based on the standard unit cost as reflected by the most current construction cost records of the Cooperative. The amount to be so paid shall be nonrefundable." This policy provides service to all applicants, even when the investment in lines and equipment is greater than the return will justify. It is necessary that the consumer requesting such service pay a portion of the costs. Please complete the enclosed Relocate Facilities Contract, and return it with your payment of $5,657,09 in the envelope provided. Construction will begin within 90 days and will take approximately 5 days to complete. The Cooperative appreciates the opportunity to serve you.
