R-99-12-09-13A1 - 12/9/1999THE STATE OF TEXAS COUNTIES OF TRAVIS AND WILLIAMSON That this Agreement Releasing and Accepting Extraterritorial Jurisdiction Property ( "Agreement ") is by and between the City of Round Rock, Texas ( "Round Rock "), a home -rule municipality located in Williamson County, Texas, and the City of Pflugerville, Texas ( "Pflugerville "), a home -rule municipality located in Travis County, Texas. That the City of Round Rock hereby agrees to release certain real property from its extraterritorial jurisdiction, said property currently lying within its extraterritorial jurisdiction and being fully described on Exhibit "A" attached hereto and made a part hereof for all intents and purposes. Further, the City of Round Rock hereby agrees to relinquish all extraterritorial jurisdictional rights to the City of Pflugerville which it has or may hereinafter acquire in said property. That the City of Pflugerville hereby agrees to accept such above - described real property into its extraterritorial jurisdiction. Further, the City of Pflugerville hereby agrees to accept all extraterritorial jurisdictional rights from the City of Round Rock on said property. That the City of Round Rock hereby agrees that the effect of this agreement is to reduce the extraterritorial jurisdiction of the City of Round Rock. Further, the governing body of the City of OQ Round Rock has given its required written consent by Resolution No. R- 99 - 13- 1;h1 in accordance with V.T.C.S., Local Government Code, §42.023. That the City of Pflugerville hereby agrees to release certain real property from its extraterritorial jurisdiction, said property currently lying within its extraterritorial jurisdiction and being fully described on Exhibit `B" attached hereto and made a part hereof for all intents and purposes. That the City of Round Rock hereby agrees to accept such above - described real property into its extraterritorial jurisdiction. R- 99- 12- 09 -13A1 A RESOLUTION APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE AN EXTRATERRITORIAL JURISDICTION AGREEMENT BETWEEN THE CITY OF ROUND ROCK, TEXAS, AND THE CITY OF PFLUGERVILLE, TEXAS, RELEASING CERTAIN REAL PROPERTY CURRENTLY WITHIN THE EXTRATERRITORIAL JURISDICTION OF ROUND ROCK INTO THE EXTRATERRITORIAL JURISDICTION OF PFLUGERVILLE, AND ACCEPTING CERTAIN REAL PROPERTY CURRENTLY WITHIN THE EXTRATERRITORIAL JURISDICTION OF PFLUGERVILLE INTO THE EXTRATERRITORIAL JURISDICTION OF ROUND ROCK; AND EVIDENCING WRITTEN CONSENT OF THE GOVERNING BODY OF ROUND ROCK TO A REDUCTION OF EXTRATERRITORIAL JURISDICTION WHEREAS, the City of Round Rock desires to release certain real property currently lying within its extraterritorial jurisdiction to the City of Pflugerville, with such real property being indicated on Exhibit "A" attached hereto and made a part hereof for all purposes; and WHEREAS, the City of Pflugerville has indicated its desire to accept such real property into its extraterritorial jurisdiction; and WHEREAS, the City Council wishes to enter into a proposed agreement whereby such real property is released from the extraterritorial jurisdiction of the City of Round Rock and simultaneously accepted into the extraterritorial jurisdiction of the City of Pflugerville; and WHEREAS, the City of Pflugerville has indicated its desire to release certain real property currently lying within its extraterritorial jurisdiction to the City of Round Rock, with such real property being indicated on Exhibit "B" attached hereto and made a part hereof for all purposes; and WHEREAS, the City of Round Rock desires to accept such real property into its extraterritorial jurisdiction; and WHEREAS, the City Council wishes to enter into a proposed agreement whereby such real property is released from the extraterritorial jurisdiction of the City of Pflugerville and simultaneously accepted into the extraterritorial jurisdiction of the City of Round Rock; Now Therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: That the Mayor of the City of Round Rock is hereby authorized to execute such agreement. AND BE IT FURTHER RESOLVED: That the governing body of the City of Round Rock, by this resolution, gives its written consent to enter into such proposed agreement and reduction of its extraterritorial jurisdiction, all in accordance with V.T.C.S., Local Government Code, §42.023. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this 2 Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended, and the Act. Consider a resolution authorizing the Mayor to execute an agreement to release property in the Round Rock extraterritorial jurisdiction (ETJ) and accept property from the extraterritorial jurisdiction of the City of Pflugerville. This agreement provides for the release of property from the Round Rock ETJ to the City of Pflugerville ETJ and in exchange accepting property from the City of Pflugerville.
