WHEREAS, the City of Round Rock has previously entered into a Contract for Engineering
Services ("Contract") with Brown & Gay Engineers, Inc. for the Railroad Quiet Zone Study Project, and
WHEREAS, Brown & Gay Engineers, Inc. has submitted Supplemental Contract No. 3 to the
Contract to modify the provisions for the scope of services, and
WHEREAS, the City Council desires to enter into said Supplemental Contract No. 3 with
Brown & Gay Engineers, Inc., Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental
Contract No. 3 to the Contract with Brown & Gay Engineers, Inc., a copy of same being attached hereto
as Exhibit "A" and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice of the date, hour, place and
subject of the meeting at which this Resolution was adopted was posted and that such meeting was
open to the public as required by law at all times during which this Resolution and the subject matter
hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended.

TO CONTRACT FOR ENGINEERING SERVICES
FIRM: BROWN & GAY ENGINEERS, INC. ("Engineer")
ADDRESS: 7000 N. Monac, Suite 330, Austin, TX 78731
PROJECT: Railroad Quiet Zone Study
This Supplemental Contract No. 3 to Contract for Engineering Services is made by and between
the City of Round Rock, Texas, hereinafter called the "City" and Brown & Gay Engineers, Inc.,
hereinafter called the "Engineer".
WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter
called the "Contract", on the 22nd day of March, 2012 for the Railroad Quiet Zone Study Project
in the amount of $149,900.00; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 1 on August 17, 2012
to amend the scope of services and to increase the compensation by $25,123.80 to a total of
$175,023.80; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 2 on June 13, 2013 to
amend the scope of services and to increase the compensation by $141,700.51 to a total of
$316,724.31; and
WHEREAS, it has become necessary to amend the Contract to modify the provisions for the
scope of services and to increase the compensation by $19,950.00 to a total of $336,674.31;
NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract
is amended as follows:

Article 1, City Services and Exhibit A, City Services shall be amended as set forth in the
attached Addendum To Exhibit A.

Article 2, Engineering Services and Exhibit B, Engineering Services shall be amended as set
forth in the attaclied Addendum To Exhibit B. Exhibit C, Work Schedule shall be amended as
set forth in the attached Addendum To Exhibit C.

Article 4, Compensation and Exhibit D, Fee Schedule shall be amended by increasing by
$19,950.00 the lump sum amount payable udder the Contract for a total of $336,674.31, as
shown by the attached Addendum to Exhibit D.
IN WITNESS WHEREOF, the City and the Engineer have executed this Supplemental
Contract in duplicate.

City Services
The City will provide the following;
A. Any mapping or survey information available for the project area.
B. Timely reviews and decisions to maintain the project schedule.
C. Coorduiation with Union Pacific Railroad.
D. Electronic files for City's Standard Details.
ADDENDUM TO EXHIBIT B
Engineering Services
Preface
The scope of services for this Supplemental Contract No. 3 is to assist the City with
the design of fencing along Bagdad Road in the vicinity of the Burnet Street railroad
crossing, in connection with fencing agreements between the City and UPRR. The
proposed fencing limits will be as follows:
Approximately 110 feet along the southern boundary of the comer lot at
the southwest corner of Bagdad Avenue and Burnet Road.
• Approximately 1,600 feet along the southern right-of-way line of Bagdad
Avenue, from Burnet Street to S Georgetown Street.
The Engineer will perform the following tasks:
A. Prepare Design Plans
1. Review existing information provided by the City and UPRR and attend
a meeting with the City to discuss project details.
2. Prepare a preliminary layout based on existing informationand
aerial photography.
3. Prepare design plans for fence installation. The plans will be on 11x17
plan sheets in accordance with the City of Round Rock design guidelines.
4. Submit plans to the City for review, and address comments from the City.
5. Prepare final plans and include in the RR Quiet Zone flan set for bid.
B. Surveying
1. Perforin ROW and utilities search in the vicinity of the project. Contact the utility
companies to have underground utilities marked in the field.
2. Perform field surveys along approximately 110 feet along the southern
boundary of the comer lot at the southwest corner of Bagdad Avenue and Burnet
Road, fiom the ROW line, a strip 20 feet wide, with cross sections every 50
feet.
3. Perform field surveys along approximately 1,600 feet along the south right.of-
way of Bagdad Avenue (north ROW line of UPRR), a strip 25 feet wide from
Burnet Street to S Black Street, and the fiill ROW width of Bagdad Street from
S Black Street to S Georgetown Street, with cross sections every 50 feet.
4. Prepare a base layout and submit drawings at 1"=50" scale. Provide electronic
files of the survey files and drawings.
