4 AN ORDINANCE AMENDING CHAPTER 24, CODE OF ORDINANCES
5 (2010 EDITION), CITY OF ROUND ROCK, TEXAS, BY ADDING
6 ARTICLE IV TO PROHIBIT URINATING AND DEFECATING IN PUBLIC;
7 PROVIDING FOR A SAVINGS CLAUSE AND REPEALING
8 CONFLICTING ORDINANCES AND RESOLUTIONS.

10 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK,
11 TEXAS:
12 I.
13 That Chapter 24, Code of Ordinances (2010 Edition), City of Round Rock, Texas,
14 is hereby amended by adding Article IV which shall read as follows:
15 ARTICLE IV. - URINATING AND DEFECATING IN PUBLIC

17 Sec. 24-75.— Definitions.

19 Public place means any place to which the public or a substantial group of the public has access
20 and includes but is not limited to streets, highways and the common areas of schools, hospitals,
21 apartment house, office buildings, transport facilities and shops.

23 Restroom means an enclosed structure with toilets or urinals installed for the purpose of urinating
24 or defecating.

26 Sec. 24-76.— Urinating or Defecating.

28 It shall be unlawful for a person to urinate and/or defecate:
29
30 (a) in or on public property;
31 (b) in or on a public place;
32 (c) in public view; or
33 (d) in or on private property when the act may be viewed by another
34
35 Sec. 24-77.—Affirmative Defense.

37 It is an affirmative defense to a violation of this article if the person was in a restroom.

39 Sec. 24-78.— Penalty.

41 A violation of this article shall be unlawful and a misdemeanor offense punishable by a fine not
42 exceeding the amount set forth in Section 1-9.

3 A. All ordinances, parts of ordinances, or resolutions in conflict herewith are
4 expressly repealed.
s B. The invalidity of any section or provision of this ordinance shall not
6 invalidate other sections or provisions thereof.
7 C. The City Council hereby finds and declares that written notice of the date,
8 hour, place and subject of the meeting at which this Ordinance was adopted was posted
9 and that such meeting was open to the public as required by law at all times during
io which this Ordinance and the subject matter hereof were discussed, considered and
i1 formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas
12 Government Code, as amended.
