Please find to follow our Commitment for Title Insurance, an email from my examiner,
a copy of the current lien we are showing on Schedule C and a Release of Lien that
the property owner brought into us for your review in connection with the above
referenced transaction.
Per my examiner's email — we need to have a Release of Lien prepared and
executed by the City of Round Rock to release Schedule C, Item 5. The Release
attached probably meant to release this Deed of Trust, but did not have the proper
language referenced in it to do so.
Please call me once you have reviewed this information to let me know if you can
facilitate the preparation of the release and the execution of the release by the City of
Round Rock.
Anything you can do to expedite this would be greatly appreciated — as the contract

WILLIAMSON County, Texas, securing THE CITY OF ROUND ROCK in the payment of one
note in the principal sum of Nineteen Thousand Nine Hundred Thirty -Nine and 40/100

There were no attachments to your e-mail, but I have generated the copies of the D.O.T. (317/735) and the
Release (2390/191) and taken a look. After conferring with Danny May on the issue, he is in agreement with the
requirement I made for a release. We both feel (and I felt, at the time of my report) that the probable intent of the
release was to release the Mech's Lien and the Deed of Trust, but all the verbiage, etc. on the release does not
take in the Deed of Trust, it only refers to the Mech's Lien, which is renewed/extended by the Deed of Trust.
We feel that the Deed of Trust (which specifically states that it covers Tract "D" and a portion of "C") needs to be
released by the City of Round Rock.
By the way, there is a specific note regarding this issue in the "Note" section of my examiner's report that I put
there when I did your report on October 18, 2004.

EXHIBIT "A"
BEING OUT of and a part of four lots out of the Jacob M.
Harrell League, Abstract No. 284, in Williamson County, Texas,
and also being a re -subdivision of lots 1, 2 and 3 of the
Saint Williams Church Subdivision, a plat of which subdivision
is of record in Cabinet A, Slide 154, Plat Records of
Williamson County, Texas, the new lots resulting from this re-
subdivision of Lots 1, 2 and 3 are designated from East to
West A, B, C, and D, the tract herein conveyed being described
by metes and bounds as follows:
BEGINNING at a point in the South line of Lot 3, a stake which
is S 43 degrees 30' W and 223.3 feet distant from the
Southeast corner of same, and is the Southwest corner of a
tract of land this day conveyed by grantors herein to David
Carlin, for the Southeast corner hereof;
THENCE N 19 degrees 13' E, with David Carlin's W. line
crossing lots 3, 2 and 1, about 520 feet to a stake in the
North line of Lot 1, S 16 degrees 45' W, and about 82.6 feet
from its Northeast corner, same being David Carlin's Northwest
corner, the Northeast corner hereof;
THENCE along the North line of Lot 1, S 16 degrees 45' W,
about 168.6 feet to a stake at its Northwest corner;
THENCE S 19 degrees E, with the West lines of Lots 1, 2 and 3,
454 feet to the Southwest corner of Lot No. 3;
THENCE along the South line of Lot 3, N 43 degrees 30' E,
113.1 feet to the place of beginning, and being all of Lot D,
and part off of the Westside Lot C, of said re -subdivision,
together with all and singular the right, members and
appurtenances to the same in any manner belonging.
