Department: Fire Department Staff Person: Howard Cruse Justification: This allows City of Round Rock Fire Department radio communication with other Regional Radio System users during joint operations, public safety critical incident responses, or other limited interoperability purposes approved by the RRSPM, (Regional Radio System Program Manager). An "Interoperability User" is a governmental agency who is not a RRS Party or RRS Associate but has been granted permission for RRS radio use under this MOU. Updated 3-10-05 MEMORANDUM OF UNDERSTANDING FOR AUSTIN/TRAVIS COUNTY 800 MHz TRUNKED VOICE REGIONAL RADiO SYSTEM INTEROPERABILITY USER ACCESS Effective Date: interoperability User: Address: Radio Equipment: November 10, 2005 City of Round Rock Fire Department 203 Commerce Blvd. Round Rock, TX 78664 Attn: Howard Cruse Telephone:512 218-6629 XX Mobile Radios XX Handheld Radios Control Station Radios Wireline Radio Patch from Interoperability User Radio System to RRS talk- group alkgroup 1) Subject to the terms of this Memorandum of Understanding ("MOU"), the Regional Radio System Program Manager ("RRSPM") hereby grants the governmental agency identified above a revocable license to use the Radio Equipment described above on the Austin/Travis County 800 MHz Trunked Voice Regional Radio System ('RRS") as an interoperability User" for the sole purpose of "Interoperability Radio Communication" on specified "talkgroups," which will be enumerated in a template plan to be approved by the RRSPM prior to radio unit programming. [If control station(s) are included in this authorization, antennas must meet the 20' rule. The physical address for control stations(s) included in this authorization is (are): N/A .] 2) "Interoperability Radio Communication" means radio communication between the external Interoperability User named above and other RRS user personnel during joint operations, public safety critical incident responses, or other limited interoperability purposes approved by the RRSPM. An "Interoperability User" is a governmental agency who is not a RRS Party or RRS Associate but has been granted permission for RRS radio use under this MOU. 3) Interoperability Users are not currently assessed a fee for use of the RRS since their use of the RRS is only for the occasional "interoperability" purposes set forth above. interoperability Users shall not use the RRS as their primary radio communication platform for internal radio communication within their own agency. Interoperability Users will not be issued their own private talkgroups. 4) Programming of Interoperability User radios for use on the RRS must be done by the City of Austin CTM - Wireless Communication Services Division staff, or other entity approved by the RRSPM. Due to the critical necessity of safeguarding the "system key," tight control over programming wilt be exercised. 5) "Emergency ID" functionality on the RRS will not be programmed into Interoperability User radios. 6) interoperability Users must identify themselves when initiating conversations on the RRS by giving their agency name (or acronym approved by the RRSPM), followed by their unit number. Example: "XYZ PD, unit 101 to APD Baker dispatch." 7) When operating radios on the RRS, Interoperability Users must abide by all applicable Federal Communications Commission rules and regulations, RRS Standard Operating Procedures, protocols set forth by individual tatkgroup owners, and decisions and directives of the RRSPM. Violations shall be grounds for immediate disconnection of the Interoperability User's radio equipment from the RRS and termination of this MOU. The Interoperability User shall reimburse the RRS Party that is the holder of an FCC license upon receipt of demand for any costs, fines or penalties assessed against the license holder as a result of a violation of an FCC rule or regulation by the Interoperability User. 8) Radio equipment and accessories shall be approved by the RRSPM prior to use on the RRS. All costs of an Interoperability User to acquire or maintain radios or other equipment, train personnel, or to connect to the RRS shall be borne and paid by the Interoperability User. (Rev. 10-26-04) c,m-os-tt -141 if 9) All Interoperability User agency personnel who will be operating approved radio equipment on the RRS will be required to undergo user training as set forth by the RRSPM, and submit to the RRSPM any required certification that such training has been received. 10) The failure of the RRS to perform its obligations under this MOU shall be excused to the extent caused by the occurrence of an event or act not within the control of the RRSPM. 11) This MOU is effective as of the Effective Date stated above, and shall remain in effect until terminated by either party upon 10 days' prior written notice. 12) The Interoperability User acknowledges that radio systems are subject to periodic outages, equipment failures, and other conditions which may prevent or interfere with radio communication. to no event shall the RRSPM or any RRS Party be liable to an Interoperability User for any claim or cause of action arising out of or related to a failure of the RRS. 13) The person executing this MOU on behalf of the Interoperability User warrants and represents that he or she has been duly authorized and empowered to execute and enter into this MOU on behalf of the Interoperability User, that all action necessary to approve this MOU has been taken, and that this MOU is a binding obligation of the Interoperability User. 14) This MOU constitutes the entire understanding of the parties related to the subject matter hereof, and there shall be no modification or waiver hereof except in writing, signed by both parties. The MOU is made under and shall be governed by the laws of the State of Texas, and is performable in Travis County, Texas.
