PARTIAL RELEASE OF PORTIONS
OF 15' PUBLIC UTILITY EASEMENTS

KNOW ALL BY THESE PRESENTS:
That the CITY OF ROUND ROCK, TEXAS, a municipal corporation situated in the Counties
of Travis and Williamson, State of Texas, for and in consideration of the sum of Ten and No/100 Dollars
($10.00) and other good and valuable consideration paid by BACK IN TEXAS, L.P, a Texas limited
partnership, the receipt and sufficiency of which is hereby acknowledged, does hereby ABANDON,
RELEASE and DISCHARGE only the portions of two 15' public utility easements which traverse the
property from north to south as shown on the plat recorded in Cabinet G, Slide 81, Plat Records of
Williamson County, Texas, and as described in a document entitled "Public Utility Easement" of record
in Volume 1520, Page 880 et seq. of the Official Records of Williamson County, Texas, to -wit:
See Exhibit "A" attached hereto and made a part hereof, which exhibit is the referenced final plat
of "The Commons" recorded in Cabinet G, Slide 81 of the Plat Records of Williamson County,
Texas, and which exhibit depicts (among other things) certain portions of 15' public utility
easements which traverse the property from north to south; and only those portions of the 15'
public utility easements which traverse the property from north to south are being abandoned,
released and discharged by this instrument; and
See Exhibit "B" attached hereto and made a part hereof, which exhibit is the referenced document
entitled "Public Utility Easement" of record in Volume 1520, Page 880 et seq. of the Official
Records of Williamson County, Texas, and which exhibit is the document which describes
(among other things) certain portions of 15' public utility easements which traverse the property
from north to south; and only those portions of the 15' public utility easements which traverse the
property from north to south are being abandoned, released and discharged by this instrument.
This instrument is given specifically to release the described portion of said easements, which
portions of said easements are terminated by abandonment, termination, vacation, and cessation of
purpose, and which portions of said easements will be of no further effect, whether legal or equitable.
IN WITNESS WHEREOF, the City of Round Rock, Texas has caused this instrument entitled
"Partial Release of Portions of 15' Public Utility Easements" to be executed on this the 18 day of the

COUNTY OF WILLIAMSON
Briercroft Savings, a Savings Association, hereinafter referred to as
GRANTORS, the owners of Lot 1 of The Commons Subdivision, a subdivision in
Williamson County, Texas, according to the map or plat thereof in Cabinet
G, Slides 81 of the Williamson County, Texas plat records, for ten Dollars
(=10.00) snd other valuable consideration pay to GRANTOR, the receipt of
which is hereby acknowledged, and the further consideration of the
benefits to be derived by GRANTORS from the public utility linos through
the above-described premises, do hereby GRANT, SELL, AND CONVEY unto The
City of Round Rock, Texas, hereinafter called GRANTEE, a public utility
easement upon and across said property, said easement being more
particularly described by metes and bounds and depicted by sketch on
Exhibit "A" attached hereto and made a part hereof.
TO HAVE AND TO HOLD the same perpetually to GRANTEE. GRANTEE'S successors
and assigns, together with the right and privilege at any and all times to
enter said premises, or any part thereof, for the purpose of constructing
and maintaining said utility lines, and making connections therewith; 611
upon the condition that GRANTEE will at all times, after doing any work in
connection with the construction or repair of said utility lines, restore
said premises to the condition in which same was found before such work
was undertaken.
