Department: Engineering and Development Services Staff Person: William J. Dobrowolski, III, P.E. Justification: The Texas Commission on Environmental Quality (TCEQ) requires that a Notice of Intent for Storm Water Discharges Associated with construction activity under the Texas Pollution Discharge Elimination System general permit be completed by the operator of the Red Bud Lane Sidewalks project. An operator is the person having operational control over construction plans and specifications to the extent necessary to meet the requirements and conditions of the general permit, or the person having day-to-day operational control over those activities at a construction site which are necessary to ensure compliance with a Storm Water Pollution Prevention Plan (SWPPP) for the site. The SWPPP document establishes a plan to manage the quality of storm water runoff from construction activities associated with the project. The County Road 122 road improvements project has a NOI that is currently active. However, because the sidewalk project is located within the same limits as the road project, the City is submitting a Notice of Change to the NOI to notify the TCEQ that the scope of work has been expanded. Instead of the City submitting a separate NOI for stormwater discharge coverage, the City has elected to submit an NOC to the road projects NOI.
