KNOW ALL PERSONS BY THESE PRESENTS:
That the City of Round Rock, a Texas home -rule municipal corporation (hereinafter called
the "Declarant") has executed this Declaration of Water Line Easement for the purpose of
establishing the following exclusive easement in and under the following described property in
Williamson County, Texas, to -wit:
0.164 acres of land, more or less, being all of that certain parcel or tract of land
situated in the Willis Donaho Survey, A-173, Williamson County, Texas, and being
more particularly described by metes and bounds in said Exhibit "A" attached hereto
and incorporated herein (Parcel 4); and
1.381 acres of land, more or less, being all of that certain parcel or tract of land
situated in the Willis Donaho Survey, A-173, Williamson County, Texas, and being
more particularly described by metes and bounds in said Exhibit "B" attached hereto
and incorporated herein (Parcel 5).
The aforementioned described property is hereinafter referred to as the "Easement".
The Easement, rights, and privileges hereby created shall be used solely for the purpose
of placing, constructing operating, repairing, maintaining, rebuilding, replacing, relocating, and
removing two (2) water distribution pipelines with all necessary conduits, casing, valves,
manholes, ventilators and appurtenances. Except as otherwise stated, the Easement and other
rights and privileges hereby created shall be perpetual.
The benefits and obligations of the Easement created herein shall constitute benefits and
servitudes running with the land.
This Declaration may be modified , amended or terminated by Declarant.

BEGINNING FOR REFERENCE at a found cotton gin spindle in the existing westerly right-of-way
line of County Road 122 (right-of-way width varies), being the southeasterly corner of said 1.698 acre
tract and an exterior ell corner in the easterly boundary line of that called 47.413 acre tract of land
conveyed to the City of Round Rock, Texas by instrument recorded in Document No. 199950368 of the
Official Public Records of Williamson County, Texas;
THENCE, departing said existing westerly right-of-way line of County Road 122, with the common
boundary line of said 1.698 acre tract and said 47.413 acre tract, S 87°01'26" W for a distance of 57.40
feet to a found iron rod in the proposed westerly right-of-way line of County Road 122 as shown on
Right -of -Way Plan Sheet prepared by Martinez, Wright & Mendez, Inc., dated July 20, 1999, being the
southeasterly comer and POINT OF BEGINNING of the herein described tract.
1) THENCE, departing said proposed westerly right-of-way line of County Road 122, continuing
with said common boundary line, S 87°01'26" W for a distance of 30.00 feet to a set 1/2" iron
rod with plastic cap, being the southwesterly comer of the herein described tract;
2) THENCE, departing said common boundary line, through the interior of said 1.698 acre tract,
with the westerly boundary line of the herein described tract, N 02°16'37" W for a distance of
252.49 feet to a set 1/2" iron rod with plastic cap in the proposed southwesterly cut-back right-of-
way line of Kiphen Road (right-of-way width varies), as shown on Right -of -Way Plan Sheet
prepared by Inland Civil Associates, being the northwesterly comer of the herein described tract;
1'11ENCE, continuing through the interior of said 1.698 acre tract, with in part, said proposed
southwesterly cut-back right-of-way line of Kiphen Road, and in part, the proposed westerly right-of-way
line of County Road 122 (right-of-way width varies), as shown on Right -of -Way Plan Sheet prepared by
