RE: Memorandum of Understanding
Chaz and George,
We have been discussing the proposed right of way acquisition of your property
on Kiphen Road for some time now. It is the purpose of this letter to place our
recent discussions in the form a Memorandum of Understanding so that we can
move forward to a mutually agreed upon resolution. I am prepared to recommend
the following course of action to the Council provided that you acknowledge the
same by your signatures below.
• Attachment "A" is a drawing that depicts an alignment of driveways and
roadways through your property. It is intended to provide CASA and
Chasco with two driveways each to your businesses. One of those
driveways at each business will be designed to allow full access by 18
wheeled vehicles to and from those businesses to Kiphen Road. Kiphen
Loop will be realigned and contain limits on driveway access as shown on
the drawing.
• Attachment "B" is a four sheet document showing current right of way
area, improvement values, and land valuation for Parcels 2, 3, and 4.
It is agreed by the parties that the value offered by the City is acceptable to the
property owners is as shown on Attachment "B" except for the square foot value
on Parcel 3. Attachment "B" calls for $0.75 per square foot ($141,722) for Parcel
"3". The proposed value is $1.50 per square foot. It is further agreed that some
redesign will be necessary to account for the proposed realignments shown in
Attachment "A". Those redesigns will change the amount of property taken so
the compensation will be adjusted accordingly by the values in Attachment "B".

With your signatures, this item will be given to the Council for action on October 12,
2006. If acceptable to all, the upcoming Special Commissioner Hearings will be
cancelled.
