CM-07-02-025THE STATE OF TEXAS COUNTY OF WILLIAMSON • • • KNOW ALL BY THESE PRESENTS: SUPPLEMENTAL AGREEMENT NO. 2 TO "STANDARD FORM OF AGREEMENT BETWEEN DESIGN-BUILDER/CONTRACTOR AND OWNER" FIRM: Grindline Skateparks, Inc. ADDRESS: 4619 14th Ave SW, Seattle, Washington 98106 REFERENCE: Design and construction services for Round Rock Skate Park, Phase I This Supplemental Agreement No. 2 to "Standard Form of Agreement Between Design- Builder/Contractor and Owner" is made by and between the City of Round Rock, Texas, hereinafter called the "City," and Grindline Skateparks, Inc., hereinafter called the "Design - Bu ilder/Contractor." WHEREAS, City and Design-Builder/Contractor executed the referenced Agreement on the Eighth (8th) day of June, 2006, and simultaneously executed the "Supplemental Agreement No. 1 (Design Services) to Standard Form of Agreement Between Design-Builder/Contractor and Owner"; and WHEREAS, it has now become necessary to amend said Agreement and Supplemental Agreement No. 1 to provide for an increased scope of services and associated payment; and WHEREAS, said action complies with Texas Local Government Code, Section 252.021 in that the increased costs represent an expenditure of less than $25,000.00; and NOW, THEREFORE, premises considered, City and Design-Builder/Contractor agree that said Agreement is hereby amended as follows: Article 4.1 shall be amended as follows: 4.1 The Owner shall pay Grindline the Contract Sum in current funds for Grindline's performance of the Contract. The Contract Sum shall be an amount not to exceed TWO HUNDRED EIGHT THOUSAND NINE HUNDRED TEN AND NO/100 DOLLARS ($208,910.00), subject to additions and deductions as provided in the Contract Documents. NOW, THEREFORE, premises considered, City and Design-Builder/Contractor agree that said Supplemental Agreement No. 1 is hereby amended as follows: Section 2.05 shall be amended as follows: 2.05 Construction Services. Construction Services shall consist generally of the services described under that heading on Exhibit "B" attached hereto and incorporated herein by reference for all appropriate purposes. 00111183/jkg CM- b1-0a-oa5 Add quarterpipe/bank area connected to street course, as depicted on attached Sheet CO1-1.1. Section 1.02 shall be amended as follows: 1.02 Compensation. City shall compensate Grindline as follows: See Exhibit "A" attached hereto and incorporated herein by reference for all purposes, said exhibit indicating that Grindline's total compensation hereunder shall not exceed $189,910.00, including any Reimbursable Expenses. To this amount, there shall be added an additional sum of $19,000.00 for increased construction services, making the total compensation hereunder $208,910.00. This amount represents the absolute limit of City's liability to Grindline hereunder unless same shall be changed by additional Supplemental Agreement hereto. Section 4.01 shall be amended as follows: 4.01 Basic Services. Payments hereunder shall not exceed the following: $208,910.00 including any Reimbursable Expenses. Department: Staff Person: Justification: PARD Rick Atkins, Parks and Recreation Director David Buzzell, Park Development Manager Due to the design changes made in the field during the construction of the bowl section (Phase 1), the transition between the bowl section and the street section could not be built per the original design. Therefore, the best and most cost effective method to insure the transitions are built correctly is to have the original Design- Builder/Contractor design and construct the transition. Funding: $390,000.00 Cost: $19,000.00 Source of funds: G.O. Bonds, TPWD Grant, Ron Sproull Fund, LCRA Partnership in Parks Grant Outside Resources: Background Information: The Greater Lake Creek Park Project involves three existing park properties and several parcels of land that the City already has or will acquire through the platting process of new neighborhoods. Clay Madsen Park, Greenlawn Park, and Lake Creek Park will all receive improvements in the form of new development and/or renovations. These three parks will also be connected with a hike & bike trail. Also included in this project will be the City's first skate park, dog park, and inline hockey facility. This project is partially funded by a Texas Parks and Wildlife Dept. (TPWD) Grant and a Grant from the Lower Colorado River Authority (LCRA). Public Comment: In addition to a focus group that was formed to specifically address end-user concerns, the Parks and Recreation department has received several petitions and numerous requests over the past three years for a skate park.
