Subject: Agreement with Albert & Wilma Landry
Good morning, yesterday I received a City Manager item related to an agreement with Albert
& Wilma Landry. All I received as part of the City Manager item was a copy of an E-mail
with information pertaining to a "draft" of the proposed easement for Mr. & Mrs. Albert
Landry.
Could you send me a copy of the proposed draft that is being sent to Mr.
& Mrs. Landry? I will need this for my City Manager records, which will confirm the reason
Jim signed the Request for Action form.
Thanks,
M Davis

That shouldn't be a problem. Do you need a copy of the RFA that he signs? That is the only
document for him to sign per Legal. I also have a note to send a signed copy of the RFA to
Lynn, per your request I will include you on the E-mail.

Steve,
See this chain below. We had previously offered Mr. Landry $4200, he demanded $6000, and I told
him that I could probably get $4500 but that was it. We also found out that he actually owns the
adjacent property instead of the owner we previously thought, so we just added a prorated amount
of $750 to his settlement for a total of $5250.
He will now take that amount. Can you or Jim e-mail your approval of this so I will have some
backup when I order the check?
Thanks.

I talked to Mr. Landry, and he may take the $4,500, but I need to know when the
construction project will start and finish (so that we will know that the project will not run
into the fall 2008 hunting season). At $4,500, Round Rock would not be compensating him
for loss of hunting rights. Since he will lose 2,500 for hunting in the 07/08 season, and
possibly another 2,500 for the 08/09 hunting season, he will deduct that amount from the
rent he pays us, and so that rental loss will have to show up in our claim with respect to the
part of the easement over our property.
Since we can now resolve Mr. Landry's easement, please send me a draft of the proposed
easement for him.
Thank you.

placed, erected or maintained thereon; (2) such improvements shall not damage facilities located
within, or materially interfere with Grantee's use and enjoyment of, the Easement Property; and
(3) no subsurface utilities of any kind shall be located within the Permanent Easement Tract
except as provided below.
5. Grantee shall not fence the Easement Property.
6. To the extent that any applicable city, county or state ordinance, regulation or
other law requires that fees, damages, compensation, penalties, or the like, be paid for the cutting
or damage of certain sizes or types of trees, and Grantee and/or its contractors cause such cutting
or damage of trees, Grantee shall be responsible for the payment of such amounts.
Notwithstanding any contrary provision in this Easement, Grantor and its heirs,
representatives and assigns shall have the right to grant utility easements crossing over or under
the Easement Property, provided that the integrity of the Grantee's lines and facilities is

employees, agents, contractors or subcontractors) causes to any of Grantor's authorized
improvements within the Easement Property. Grantee shall not be responsible for damage it
causes to unauthorized improvements within the Easement Property.
