Explain that to me. Original Message From: Don Childs Sent: Thursday, March 29, 2007 12:27 PM To: Steve Sheets Subject: FW: Raw Water Line --Landry settlement Steve, See this chain below. We had previously offered Mr. Landry $4200, he demanded $6000, and I told him that I could probably get $4500 but that was it. We also found out that he actually owns the adjacent property instead of the owner we previously thought, so we just added a prorated amount of $750 to his settlement for a total of $5250. He will now take that amount. Can you or Jim e-mail your approval of this so I will have some backup when I order the check? Thanks. Don Original Message From: Jim Avant [mailto:JFA@DAPLaw.com] Sent: Tuesday, March 13, 2007 10:12 AM To: Don Childs Subject: RE: Round Rock/ Albert Landry Don, ev-o1-o&-lob 6/20/2007 Message Page 2 of 3 I talked to Mr. Landry, and he may take the $4,500, but I need to know when the construction project will start and finish (so that we will know that the project will not run into the fall 2008 hunting season). At $4,500, Round Rock would not be compensating him for loss of hunting rights. Since he will lose 2,500 for hunting in the 07/08 season, and possibly another 2,500 for the 08/09 hunting season, he will deduct that amount from the rent he pays us, and so that rental loss will have to show up in our claim with respect to the part of the easement over our property. Since we can now resolve Mr. Landry's easement, please send me a draft of the proposed easement for him. Thank you. Jim F.
