TO CONTRACT FOR ENGINEERING SERVICES

PROJECT: Austin & Liberty Avenue Improvements
This Supplemental Contract No. 2 to Contract for Engineering Services is made by and between
the City of Round Rock, Texas, hereinafter called the "City" and Kasberg, Patrick & Associates,
L.L.P., hereinafter called the "Engineer".
WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter
called the "Contract", on the 28th day of April, 2005 for the Austin & Liberty Avenue
Improvements in the amount of $113,785.00; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 1 on the 10th day of
November, 2005 to modify the provisions for the scope of services, to increase the compensation
by $200,700.00 to a total of $314,485.00, to extend the Contract, and to modify the provision for
notices to proceed; and
WHEREAS, it has become necessary to amend the Contract to modify the provisions for the
scope of services, to increase the compensation by $33,000.00 to a total of 347,485.00, and to
change the City's Designated Representative for purposes of this Contract and to change the
Engineer's Designated Representative for purposes of this Contract; and
NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract
is amended as follows:
I.
Article 2, Engineering Services and Exhibit B, Engineering Services shall be amended as set
forth in the attached Addendum To Exhibit B. Exhibit C, Work Schedule shall be amended as
set forth in the attached Addendum To Exhibit C.
II.
Article 4, Compensation and Exhibit D, Fee Schedule shall be amended by increasing by
$33,000.00 the lump sum amount payable under the Contract for a total of $347,485.00, as
shown by the attached Addendum to Exhibit D.

ADDENDUM TO EXHIBIT B
Engineering Services
The following is a list of services that will be performed by Kasberg, Patrick & Associates, LP as
part of a Contract Amendment to the original Austin & Liberty Avenue Improvements Contract for
the Final Engineering Design of Austin Avenue Utilities from N. Nelson Street east to Pecan Lane
and Liberty Avenue Roadway, Drainage & Utilities Improvements from N. Nelson Street east to the
dead end of Liberty Avenue:
1. Determine final horizontal and vertical roadway alignment for Liberty Ave. from N.
Nelson Street east to the dead end of Liberty Ave.
2. Determine final street cross sections for the proposed Liberty Ave, extension.
3. Determine final horizontal and vertical alignment for the proposed 4 -foot sidewalk
along the proposed Liberty Ave. extension.
4. Determine final horizontal and vertical alignment for replacement of the existing
water lines located within the right-of-way of the proposed Liberty Ave. extension
and for the proposed Austin Ave, utilities extension from N. Nelson St east to Pecan
Lane. This will include detailing connections to existing water line and detailing
connections to existing water meters.
5. Determine final horizontal and vertical alignment for replacement of the existing
wastewater lines for the Austin Ave. utilities extension from N. Nelson St east to
Pecan Lane. This will include detailing connections to existing wastewater manholes
and detailing connections to existing wastewater services.
6. Complete final storm water conveyance for the Liberty Ave. extension.
7. Determine final horizontal and vertical alignment for the storm sewer lines as well as
curb inlets and culverts based on the final storm water conveyance for the Liberty
Ave. Extension.
8. Provide telephone, cable fiber optic, electrical and gas utility entities with
construction plans showing horizontal and vertical alignment in order that they will
be able to relocate existing utilities outside the limits of construction.
9. Develop final opinions of probable costs for the Liberty Ave. Extension and Austin
Ave, Utilities Extension and incorporate them with the current Austin & Liberty Ave.
Improvements Project.
10. Amend the Contract Documents to reflect the proposed Liberty Ave. Extension and
Austin Ave. Utilities Extension.
11. TCEQ Recharge & Transition Zone Exception request approval.
12. SWPPP Plans & Program.
13. Submit plans to TDLR for review & approval.
14. Meet with the City of Round Rock Staff to review the Final Design Engineering Plans
and the Contract Documents and Technical Specifications and receive input on the
plans. Meetings shall be phased with the City of Round Rock Staff.
15. Incorporate changes or revisions as a result of review comments made by the City of
Round Rock Staff.
16. Deliver ten (10) copies of the Final Design Engineering Plans and Contract
Documents and Technical Specifications to the City of Round Rock.

ITEM: Action authorizing the City Manager to execute Supplemental
Contract #2 for Professional Services Contract with Kasberg, Patrick,
and Associates, LLP for Austin and Liberty Avenue Improvements.

Justification:
Supplemental Contract #2 broadens the scope to include needed infrastructure
improvements on the eastside of this project. Supplemental Contract #2 will increase the
total amount of compensation of this contract to $346,785.00.
Funding:
Cost: $33,000.00
Source of funds: 2001 GO Bonds (2nd Issuance)

Background Information:
Supplemental Contract #2 increases the scope of this project to include water
improvements on Austin Avenue, and water, wastewater, street, and drainage
improvements on Liberty Avenue east of Nelson Street. The condition of these City owned
infrastructure units has deteriorated greatly in the last few months.
