RE: Settlement discussions
Chaz and George,
The purpose of this letter it to set forth the results of our recent discussion
regarding a settlement that will result in the City's acquisition of a portion of your
property for right of way for proposed improvements to Kiphen Road. I would
like to present this proposed settlement to the City Council at its next meeting on
Thursday, June 28, 2007. Accordingly, I am prepared to recommend the
following settlement terms to the Council provided that you acknowledge the
same by your signatures below.
• You have reviewed and agreed to plans that the City prepared with respect
to access to your two properties;
• You have agreed to accept the amounts shown Attachment "A" as total
compensation for the right of way needed from your properties; and
• The City agrees to include and construct as part of the project two eight
inch (8") waterlines to the property as generally shown on Attachment
If minor design changes alter the amount of property taken the compensation will
be adjusted accordingly by the values in Attachment "A". Upon approval of this
settlement offer by the City Council, you will execute documents giving the City
right of entry so that begin construction of the project may begin while the final
closing of the transaction is pending.
